المستخلص: تسعى هذه الدراسة إلى تحليل واقع التأجير التمويلي في الجزائر وذلك من خلال التطرق إلى شروط تأسيس شركات التأجير التمويلي في الجزائر ودراسة تطورها ثم تحديد المشكلات التي تواجه نشاط التأجير التمويلي في الجزائر مع اقتراح حلول للتغلب عليها. توصلت الدراسة إلى أن أطراف نشاط التأجير التمويلي تستفيد بمزايا عديدة، فشركات التأجير التمويلي والمؤسسات المالية (المؤجر) تحقق من خلال عملية التأجير التمويلي عوائد مالية لا تقل أهمية عن تلك المتأتية من الفرص البديلة، كما تستفيد الشركات والمشروعات الاقتصادية (المستأجر) بزيادة قدراتها الإنتاجية وتطويرها ويستفيد الاقتصاد الوطني من زيادة الاستثمارات الإنتاجية والدفع بالتنمية الاقتصادية إضافة إلى مزايا أخرى تشمل جميع الأطراف، كما أن نشاط التأجير التمويلي في الجزائر لا يزال يواجه كثيرًا من العقبات مرتبطة بالمناخ الاستثماري والإطار القانوني والجبائي والبنية الاجتماعية والثقافية تحد من توسعه، لذا نوصي بضرورة توفر عناصر أساسية تذلل هذه العقبات كتطبيق مبادئ الحوكمة وآلياتها، توفر البنية القانونية المناسبة، والبيئة الاقتصادية والمالية، والبشرية والاجتماعية.

This study is aiming to analyze the reality of financial leasing in Algeria, by examining the conditions for incorporation financial leasing companies in Algeria, and study its development, then identify the problems of the leasing activity in Algeria, and propose solutions to overcome them. The study found that the parties of the financial leasing activity benefit from several advantages, leasing companies and financial institutions (the lessor) obtain, through the leasing process, financial returns no less important than those coming from alternative opportunities. Companies and economic projects (the lessee) benefit also by increasing and developing their production capacities, the national economy benefits from increasing productive investments and pushing economic development in addition to other benefits that include all parties. In addition, the financial leasing activity in Algeria still faces many obstacles related to the investment climate the legal and fiscal framework, and the social and cultural infrastructure that limits its expansion. Therefore, we recommend the necessity of providing basic elements that overcome these obstacles, such as applying the principles of governance and its mechanisms, providing the appropriate legal structure, and the economic, financial, human and social environment.
