المستخلص: لم تكن حقوق الإنسان البيئية محل اهتمام المجتمع الدولي إلا بعد إعلان استكهولم عام ١٩٧٢، إذ يعتبر هذا الإعلان نقطة الانطلاق بالنسبة إلى المجتمع الدولي في مجال حماية البيئة من التلوث الذي تؤثر بشكل مباشر وفعال في حقوق الإنسان المعترف بها بموجب الاتفاقيات والإعلانات الدولية إذ إن التلوث يشكل تهديدا مباشر على الحق في الصحة وهو حق معترف به في جميع الصكوك الدولية، حيث يعتبر الحق في البيئة النظيفة هو حق مستقل عن سائر الحقوق الأخرى وذو تأثير مباشر على الحقوق الأخرى كالحق في الحياة والحق في الصحة، إذ أن الاعتراف الدولي بالحق هو الذي يوفر الحماية الدولية لهذا الحق من أن ينتهك وذلك من خلال تنظيمه بموجب اتفاقية دولية أو إعلان دولي حيث يعتبران الوسيلتين الفاعلتين في المجتمع الدولي، هذا بالإضافة إلى أعمال المنظمات الدولية لما تصدره من قرارات إذ تلعب الأمم المتحدة دور كبير في حماية السلم والأمن الدوليين وذلك من خلال الجمعية العامة ومجلس الأمن حيث تعتبر قرارات الأخير ملزمة لجميع الدول وبالتالي تترتب المسؤولية الدولية على الدولة التي تخالفه، كل هذه تعتبر أساسا قانونيا لما يتمتع به الضحايا من حقوق.

Environmental human rights were not the concern of the international community until after the Stockholm Declaration in 1972, as this declaration is considered the starting point for the international community in the field of environmental protection from pollution, which directly and effectively affects human rights recognized under international agreements and declarations as pollution is a threat Directly on the right to health and it is a right recognized in all international instruments, where the right to a clean environment is a right independent of the rest of other rights and has a direct impact on other rights such as the right to life and the right to health, since the international recognition of the right is the one that provides international protection This right has the right to be violated by regulating it according to an international agreement or an international declaration, as they are considered effective means in the international community, in addition to the work of international organizations for its decisions, as the United Nations plays a major role in protecting international peace and security through the General Assembly and the Council Security, as the latter’s decisions are binding on all states, and therefore international responsibility arises from the state that violates it. All of these are considered a legal basis for the rights of the victims.
