المستخلص: أن الفصل في صحة العضوية النيابية تعد المرحلة الأخيرة من مراحل الرقابة في صحة وسلامة العضوية البرلمانية، نظرا لأهمية المركز الدستوري لأعضاء البرلمان باعتبارهم يشغلون إحد المؤسسات الدستورية الهامة في الدولة نظر لما ما يقومون به من تأدية مهام وواجبات التشريع للقوانين والرقابة على أعمال الدولة. حرصت بعض الدساتير في أسناد مهمة الفصل في صحة عضوية أعضاء البرلمان إلى البرلمان ذلك تطبيقا لقاعدة الرقابة الذاتية لضمان واستقلال المجالس النيابية عن السلطتين القضائية والتنفيذية، وفقا لمبدأ الفصل بين السلطات وضمانات دستورية بشأن استقلال البرلمان بشؤون أعضائه عن سائر باقي السلطات، أذ خول البرلمان هذا الاختصاص بالفصل في صحة عضوية أعضائه بمثابة أناطته اختصاصا قضائيا أصيلا مستمدا من الدستور ذاته وتكون إرادة السلطة التأسيسية بمثابة هي في مقام توزيع الاختصاصات على سلطات المؤسسات الدستورية ورغبة البرلمان بالاحتفاظ من دون غير بذلك الاختصاص حرصا على استقلاله ومنعا للتدخل في شؤونه في هذه الفترة.

The decision on the validity of parliamentary membership is the last stage in the promotion of the health and safety of parliamentary membership, given the importance of the constitutional position of members of parliament, considering them occupying one of the important constitutional institutions in the state due to the duties and duties they perform in performing the legislative tasks and duties of the laws and overseeing the state's activities Some constitutions have been keen to assign the task of determining the validity of the membership of members of parliament to the parliament that is in application of the rule of self-monitoring to guarantee the independence of parliaments from the judicial and executive authorities, in accordance with the principle of separation of powers and constitutional guarantees regarding the independence of parliament in the affairs of its members from all the rest of the authorities, since Parliament has authorized this jurisdiction By deciding on the validity of its members ’membership, it is tantamount to assigning it a genuine jurisdiction derived from the constitution itself, and the will of the constituent authority is tantamount to the distribution of competencies over the powers of the constitutional institutions, and the parliament’s desire to retain this competence without others, in order to ensure its independence and to prevent interference in its affairs during this period.
