المستخلص: Le permis de conduire est l'une des décisions administratives qui concerne la personne qui l’a demandé au même titre qu’un permis de construire. Un droit dont jouit l'individu au sein de l'Etat, indépendamment de son sexe, de sa nationalité, de son statut, et de ses conditions matérielles ou affiliation. Cependant, ce droit est limité par un ensemble de restrictions et de conditions imposées par l'intérêt public, en particulier la sécurité publique et la sécurité routière. Les autorités de régulation et de contrôle du trafic veillent à ce que ces conditions soient remplies par le demandeur de permis comme mesure de précaution afin de maintenir l’ordre public en matière de trafic routier.

تعد رخصة السياقة من القرارات الإدارية التنفيذية التي تتعلق بشخص طالبها تمام كرخصة البناء، وهي تعد حقا من الحقوق التي يتمتع بها الفرد داخل الدولة، إذ يحق لكل شخص مهما كان جنسه أو جنسيته أو صفته أو حالته المادية أو انتماؤه، أن يحصل عليها تطبيقا لمبدأ المساواة في الانتفاع بخدمات المرافق العامة، غير أن هذا الحق مقيد بمجموعة من القيود والشروط تفرضها مقتضيات المصلحة العامة، وبالخصوص الأمن العام وسلامة الطرقات وتسهر سلطات الضبط الإداري المروري على توفرها في طالب الرخصة، بحزم كإجراء احترازي في سبيل الحفاظ على النظام العام المروري.

A driving license is considered to be one of the executive administrative decisions that pertain to a person who has fully demanded the building permit. It is a right of the individual within the state. Every person, regardless of his sex, nationality, status, material condition or affiliation, is entitled to apply the principle of equality. However, this right is restricted by a set of restrictions and conditions imposed by public interest, especially public safety and road safety. Traffic control authorities ensure that they are available in the applicant as a precautionary measure in order to maintain the public traffic system.
