| 520 | |d L’utilité publique est considérée comme une condition obligatoire, pour établir de véritables opérations de développement, cette utilité publique a un caractère discrétionnaire. Le contrôle du conseil d'Etat Français sur cette condition a connu une évolution, allant d’un contrôle abstrait à un contrôle concret suivant la théorie du bilan couts-avantages, pour cette raison le juge administratif joue un rôle important pour définir l’utilité publique. En Algérie on constate une contradiction dans la jurisprudence du conseil d’Etat sur l’utilité publique, du fait qu’il ne s’est résigné Sur une jurisprudence unifiée ce qui explique l’hésitation entre l’exercice du contrôle à l’abstention de le faire ,cet jurisprudence. Qu’il fallait rattraper car il se trouve un ensemble de motifs qui oblige le juge algérien à exercer son rôle de contrôle plein sur l’utilité publique. | ||
| 520 | |b The Public utility is considered as an obligatory condition to the legitimacy of the expropriation operations, which is distinguished with a discretionary character. The French state Council censorship was developed from an abstract censorship to a new concrete one caused by the balance theory between the cost-benefit in which – the administrative judge – became able to take part in defining the common service. For the Algerian State Council, we notice a decrease on the basis of its judicial efforts which caused the hesitation between practicing and refusing the censorship. This situation should be resolved due to reasons that oblige the Algerian judge to apply all his supervisory functions without limits in the condition of the Public utility. | ||
| 520 | |a تعتبر المنفعة العامة شرطا إلزاميا لصحة عمليات التنمية، وهي تتسم بطابع تقديري. تطورت رقابة مجلس الدولة الفرنسي، على هذا الشرط من رقابة مجردة إلى رقابة ملموسة بموجب نظرية الموازنة بين المنافع والأضرار، حيث أصبح القاضي الإداري يؤدي دورا كبيرا في تحديدها. في الجزائر نلمس تباين وتناقض الاجتهاد القضائي لمجلس الدولة لعدم استقراره على اتجاه واحد جسد بموجبه التردد بين ممارسة الرقابة والامتناع عنها. هذا الاتجاه يجب تداركه لوجود مجموعة من المبررات تقتضي ممارسة القاضي الجزائري لدوره الرقابي كاملا غير مبتور على المنفعة العامة. | ||
