المستخلص: سعى البحث إلى تأييد أهمية العناية بالدرس الفقهي والأصولي في كليات الحقوق المصرية مع المقارنة بأحكام القوانين الوضعية؛ باعتباره من أهم أسس التوحيد القانوني بين البلاد العربية؛ ذلك أنه تراث حضاري يجدر أن نلقي عليه الضوء عند دراسة القانون الوضعي؛ إذ استكمال الشخصية العربية بل العمران البشري يقتضي الرجوع إلى هذا الدرس والاعتماد عليه كمصدر أساسي للقانون العربي الموحد. وبذلك ينتهض النظر الفقهي والأصولي قانونا للتعامل مع النصوص؛ الواضح في سؤال النبي صلى الله عليه وسلم معاذا رضي الله عنه، يعلمه أصول الحكم بالإسلام، في قوله الشهير: "بم تقضي إن عرض لك قضاء؟" ومن ثم فالبحث ماض إلى تحقيق مقاصد وغايات، أساسها: تعيين علم الفقه وأصوله قانونا ضابطا لكيفية الاستنباط والاستدلال الفقهي، ورفع الخلاف بين فئات الفقهاء؛ والتعويل على منهج حفظ الشريعة من التوظيف السياسي، أو التطويع المصلحي؛ فالأخذ بالمصالح والعمل بها لابد أن يكون لمقصود شرعي، وإلا كان مطية للتشهي؛ إذ كل مصلحة لا ترجع إلى حفظ مقصود شرعي، ولم تلائم تصرفات الشرع فهي باطلة مطرحة. كما أكد البحث كون الفقه الإسلامي وأصوله - وهو الطريق لفهم الشريعة- من العلوم التي تفخر بها الحضارة الإنسانية؛ فهو الذي يضبط السلوك البشري في العبادات والمعاملات والأحوال الشخصية، وفهم المقاصد الرئيسة من الخلق وما يستتبعه من العمارة والاستخلاف، حتى بعد الموت من خلال المواريث والوصايا والأوقاف وغيرها.

The research sought to support the importance of paying attention to the jurisprudential and fundamentalist study in Egyptian law schools with comparison with the provisions of man-made laws. As one of the most important foundations of legal unification among the Arab countries; That is because it is a cultural heritage that should be shed light on when studying positive law. As the completion of the Arab character, but rather human development, requires returning to this lesson and relying on it as a basic source for unified Arab law. Thus, the jurisprudential and fundamentalist consideration is a law for dealing with texts. What is clear in the question of the Prophet, may God’s prayers and peace be upon him, Mu'adh, may God be pleased with him, taught him the principles of governance in Islam, in his famous saying: “What do you make if you are offered judgment? Hence, the research is proceeding towards the realization of goals and objectives, the basis of which is: Defining the science of jurisprudence and its principles legally governing the method of deduction and jurisprudential reasoning, and raising disagreement between categories of jurists Relying on the method of preserving the Sharia from political employment or interest-based recruitment; Adopting interests and acting upon them must have a legitimate aim, otherwise it is a vehicle for lust; Since every interest is not due to the preservation of a legitimate intention, and it does not suit the actions of the Sharia, it is null and void. The research also confirmed that Islamic jurisprudence and its origins - which is the way to understand Sharia - are among the sciences that human civilization is proud of. It is he who controls human behavior in worship, transactions and personal status, and understanding the main purposes of creation and the ensuing architecture and succession, even after death, through inheritance, wills, endowments, etc.
