المستخلص: هدفت الدراسة إلى بيان القيود الاستثنائية لحرية التنقل في ظل جائحة كورونا بين حالة الطوارئ الصحية التي فرضتها الدول وضمان الحق في التنقل باعتبار أنه إذا كان إعلان حالة الطوارئ أمر ضروري على أساس أنه نظام استثنائي يضمن حفظ النظام العام للدولة ويحفظ أمن الأشخاص وحقهم في التنقل. لذلك حاولنا توضيح كيف يمكن التوفيق بين الحد من حرية التنقل في ظل جائحة كورونا كوفيد ١٩ وبين حماية الحقوق والحريات كواجبات للدولة، وفقا للنظام الدستوري مع تحول فيروس كورونا كوفيد ١٩ إلى وباء عالمي، يمثل خطر على الإنسانية ويهدد الحق في الحياة الذي يشكل أول الحقوق وأبرزها مما دفع أغلب دول العالم التي أصيبت بفيروس كورونا المستجد إلى إعلان حالة الطوارئ الصحية، لاحتواء المرض والحد من انتشاره؛ فسارعت الدول إلى إغلاق حدودها كما فرضت الحكومات حظرا على التجمعات في الأماكن العامة وعلقت المدارس ورحلات الطيران وتم تقييد حرية التنقل بأساليب متنوعة من قبل العديد من حكومات المجتمع الدولي أو ضمن إقليم الدولة ذاته، وبنيت هذه القيود عموما على الصحة العامة، أو النظام، أو مبررات للسلامة، والحق في الحياة.

The study aimed to clarify the right to freedom of movement in light of the Corona Covid 19 pandemic between the state of health emergency imposed by countries and the guarantee of the right to movement, given that if the declaration of a state of emergency is necessary on the basis that it is an exceptional system that guarantees the preservation of the state's public order and preserves the security of people and their right to movement. Therefore, we tried to clarify how it is possible to reconcile the limitation of freedom of movement in light of the Corona Covid 19 pandemic with the protection of rights and freedoms as duties of the state, according to the constitutional order with the transformation of the Corona Covid 19 virus into a global epidemic, which represents a threat to humanity and threatens the right to life, which is the first and most prominent of the rights. This prompted most of the countries in the world that were infected with the emerging coronavirus to declare a state of health emergency, to contain the disease and limit its spread. Countries quickly closed their borders, and governments imposed a ban on gatherings in public places, schools and flights were suspended, and freedom of movement was restricted in a variety of ways by many governments of the international community or within the state's territory itself, and these restrictions were generally based on public health, order, or justifications. For safety, and the right to life.
