المستخلص: يهتم البحث بجريمة التلاعب في البورصة في نظام السوق المالية الذي أدخلته المحكمة العربية السعودية لتنظيم تداول الأوراق المالية وأسمته نظام السوق المالية منذ 2003م، وقد صدر بالمرسوم الملكي رقم 2/30 بتاريخ 2/6/1424ه الموافق 31/7/2003م، وقد قصرنا في معرض معالجتنا تلك الجريمة على وضع إطار مفاهيمي لها في ضوء نظام السوق المالية السعودية مع تمييزها عن غيرها من الجرائم الأخرى حتى يستطيل الوقوف على أحكام المسئولية عن جريمة التلاعب في البورصة في النظام السعودي والتشريعات المقارنة وطرق مكافحة التلاعب في أسعار العالمية لرفعها بطريقة مصطنعة بغرض الكسب المالي والمضاربة غير المشروعة، الأمر الذي يؤدي إلى انهيار سوق الأوراق المالية ومن ثم انحرافه عن تحقيق وظائفه التي يرنو إلى تحقيقها. وقد برزت أهمية هذا الموضوع والذي طرح نفسه بشدة في الآونة الأخيرة بسبب الأزمات المالية المتكررة التي يواجها السوق المالية بصفة عامة وتداعت أصداؤها في بقاع العالم المختلفة، وقد اتخذت بعض مظاهر تلك الأزمة انهيار السوق المالية (البورصة) في الولايات المتحدة وفي العديد من بقاع الأرض. وإذ وضع المنظم السعودي خطة ساير فيها التشريعات المعاصرة من حيث التصدي لتلك الجريمة الأخطر في سوق الأوراق المالية من خلال وضعه مجموعة من القواعد التي تحكم المسئولية عن تلك الجريمة؛ ومن ثم ملاحقة مرتكبيها بكافة صورها التجريمية، وذلك بهدف مكافحة أثارها وانعكاساتها على الاقتصاد القومي، بل وقد تفوق على بعض من التشريعات كالتشريع المصري في تخويله أجهزة إدارية متخصصة سلطة الضبط القضائي في مجال الكشف عن جرائم السوق المالية وتجميع الأدلة في شأنها، حيث يسمح لهيئة السوق المالية بالجمع بين سلطات الضبط القضائي وسلطات التحقيق وسلطة الادعاء،، الأمر الذي جعل لهذا الموضوع الحيوي أهميته في البحث والتصدي لدراسته لإلقاء الضوء على أهم جوانبه. ومن ثم فقد تم تناول بحث: "جريمة التلاعب في البورصة وأثرها وطرق مكافحتها" من خلال المحثين التاليين: المبحث الأول: الأحكام العامة بجريمة التلاعب في البورصة. المبحث الثاني: أحكام المسئولية عن جريمة التلاعب في البورصة وطرق مكافحتها.

The research is concerned with the crime of manipulating the stock exchange in the financial market system that was introduced by the Saudi Arabian Court to regulate the circulation of securities and called the financial market system since 2003 AD, and it was issued by Royal Decree No. In the course of our treatment of this crime, we have to develop a conceptual framework for it in the light of the Saudi financial market system, while distinguishing it from other crimes, so that the provisions of the responsibility for the crime of manipulating the stock exchange in the Saudi system, and the comparative legislation and methods of combating manipulation in international prices to raise them in an artificial way for the purpose of gain Financial and illegal speculation, which leads to the collapse of the stock market and then its deviation from achieving the functions that it aspires to achieve. The importance of this topic, which has emerged strongly in recent times, has emerged due to the repeated financial crises facing the financial market in general, and their reverberations in various parts of the world. As the Saudi regulator has drawn up a plan in which contemporary legislation is in line with regard to addressing this most serious crime in the stock market by setting a set of rules governing responsibility for that crime; And then to prosecute the perpetrators in all their criminal forms, with the aim of combating their effects and repercussions on the national economy. It has even surpassed some legislations such as the Egyptian legislation in authorizing specialized administrative bodies the power of judicial control in the field of detecting financial market crimes and gathering evidence in them, as the Market Authority allows Finance by combining judicial control authorities, investigation authorities and the prosecution authority, which made this vital topic important in research and addressing its study to shed light on its most important aspects. Hence, a research has been addressed: “The crime of stock market manipulation, its impact and ways to combat it” through the following researchers: The first topic: General provisions for the crime of stock market manipulation. The second topic: the provisions of responsibility for the crime of manipulating the stock exchange and ways to combat it.
