المستخلص: نهدف من خلال هذه الورقة البحثية إلى تقديم خلفية نظرية وحالة عملية عن أسواق الأوراق المالية ومنتجات الهندسة المالية المتداولة فيها المرتكزة على أسس ومبادئ الشريعة الإسلامية، وإلى تقديم خلفية عن هذا السوق- سوق الخرطوم للأوراق المالية- وعن أداءه والتعريف بمنتجات الهندسة المالية التي تطرح للتداول فيه، وعن أهم التحديات التي تواجهه، إضافة إلى محاولة التعرف على أثر تداول منتجات الهندسة المالية الإسلامية على نشاط هذا السوق. وتوصلت الدراسة إلى ضرورة قيام سوق للأوراق المالية يقوم على أسس الشريعة الإسلامية يتوفر على منتجات مالية مطورة ومبتكرة وإيجاد منفذ تطبيقي فعال لها يستفاد منه ومنها، متمتعة بالكفاءة الاقتصادية والمصداقية الشرعية، هذا عن طريق توحيد الفتاوى الشرعية والإلزام بها.

On veut par cette étude présenter un arrière plan théorique et un cas pratique sur les marchés des titres financiers et les produits D’ingénierie financière qui y sont échangés et qui sont fondés sur les principes de la charia islamique, d’un autre coté on va présenter un arrière plan sur ce marché -le marchés des titres financiers de Khartoum- et définir les produits D’ingénierie financière qui y sont lancés pour les échanges et les importants défis qui se tiennent face à lui et essayer de reconnaitre l’impact de ces échanges sur les activités du marché. On est arrivé au bout de cette étude qu’il est indispensable que le marché des titres financiers soit fondé sur les principes da la charia islamique et doit contenir des produits financiers développés et novateurs, aussi il faut lui trouver une issu pratique et efficace qui peut être bénéfique pour tous, il doit être efficace économiquement et avoir la crédibilité avec la charia, et ça par le biais de l’unification des fatwas et leur aspect obligatoire.

We aim through this research paper to provide a theoretical background and a practical case for the stock markets and the financial engineering products traded in them based on the foundations and principles of Islamic Sharia and to provide a background on this market - the Khartoum Stock Exchange - and its performance and the definition of financial engineering products that are offered for trading in it and about the most important challenges it faces, in addition to trying to identify the impact of trading Islamic financial engineering products on the activity of this market. The study concluded the need to establish a stock market based on the foundations of Islamic Sharia with developed and innovative financial products and finding an effective application outlet for them to benefit from them, enjoying economic efficiency and Sharia credibility, by unifying and obligating Islamic fatwas.
