المستخلص: توصلت محاولتنا لدراسة المستهلك بين المفهومين الإسلامي والوضعي إلى ضرورة استفادة التعريفات الوضعية من المفاهيم والسلوكات والممارسات الإسلامية، التي ترى حماية المستهلك في وجود فرد صالح قبل كل شيء، يمنعه خوف الله ويحفزه على مراعاة حقوق الآخرين قبل حقوقه هو، وحتى وإن التقت النظرتان في نقاط مشتركة إلا أن ذلك يبقى جزئيا، وهو ما يتطلب من المقرر في الجزائر أن يلتفت إلى الخير الذي يحوزه التراث الإسلامي، حماية لكل الفاعلين في الموضوع.

Notre tentative d'étudier la protection du consommateur entre les concepts islamiques et l’économie positive, arrive a une conclusion centrée sur la nécessité des attitudes et des pratiques islamique, qui voit la protection du consommateur par l'existence d'une bonne personne avant tout. La crainte du dieu l’empêche de l’injustice et l'incite de prendre en compte les droits des autres avant ses droits. Et même si les deux avis ont rencontré sur des points communs, cela restera en partie vrai et pas complètement, ce qui exige en Algérie de se tourner vers le bien tenu par l'héritage islamique, afin de protéger tous les acteurs.

Our attempt to study the consumer between the Islamic and positivist concepts concluded that the positive definitions should benefit from Islamic concepts, behaviors, and practices, which see consumer protection in the presence of a righteous individual above all. Fear of Allah prevents and motivates him to take into account the rights of others before his own, even if the two views meet on common points. However, this remains partial, which requires the decision-maker in Algeria to pay attention to the good possessed by the Islamic heritage to protect all actors in the matter.
