لا يخفى على أحد ما آل إليه التطور العلمي الحديث الذي غزى مختلف مناحي الحياة بما في ذلك مجال الطب وعلوم الإحياء، ولعل عمليات نقل وزراعة الأعضاء البشرية إحدى أهم صور هذا التقدم، الأمر الذي دعا فقهاء الشريعة الإسلامية إلى محاكاته من خلال رصد حكم شرعي لهذه العمليات، بالموازاة مع التنظيم التشريعي لها سواء في إطار التشريع الدولي أو التشريعات الوطنية أو الإقليمية. ويعد مبدأ المجانية في نقل وزراعة الأعضاء البشرية من أبرز المبادئ التي ارتكب عليها هذا الحقل، حيث عملت جل التشريعات المنظمة له على سن مقتضيات تلزم الفاعلين فيه بتحري المجانية وعدم مالية هذه العملية، باستثناء الواجبات المستحقة من عمليات الاستشفاء، بل عملت على تجريم المتاجرة وبدل المقابل في هذا الخضم. وفي ثنايا هذه الدراسة حاولت إبراز المشروعية القانونية والشرعية لعمليات نقل وزراعة الأعضاء البشرية، كما عملت على رصد المبادئ العامة التي يرتكز عليها هذا المجال، وكذا الحماية التي أولتها مختلف التشريعات لمبدأ المجانية سواء في إطار التشريع الوطني أو الدولي.
