المستخلص: هذا البحث الموسوم بــ(قواعد الإفتاء – نماذج وتطبيقات) هدف إلى بيان أمثلة ونماذج من الأسس والكليات الكثيرة التي ينبغي للمفتي والمخبر عن حكم الله تعالي أن يعلمها ويستصحبها عند إفتائه وبيانه لحكم الله تعالي لمن سأل عنه. وبلا شك أن هذا الموضوع من الأهمية بمكان، إذ أنه ينبه إلى أن هنالك قواعد كثيرة وكليات يحسن بل ينبغي للمفتي معرفتها وملاحظتها واعتبارها عند ولوجه باب الإفتاء، حتى يُقدم علي بيان حكم الله تعالي على هدي وبصيرة. وهذا البحث جاء بمثابة نماذج لهذه القواعد والكليات، وذلك على سبيل المثال لا الحصر، وقد اشتمل على أهم ثلاث قواعد من تلك القواعد بصيغها المتعددة التي وردت بها، مع شرحها وبيان معناها والتدليل عليها، وذكر أمثلة وتطبيقات وفروع انبنت عليها، وقد استخدم في هذا البحث المنهج التحليلي وخلص إلى نتائج هامة هي أن: للفتوي قواعد وكليات وضوابط يجب على من تصدي للفتوي الإلمام بها واعتبارها في فتواه. مهمة المفتي هي إخبار بالحكم الشرعي وبيان له، وليس من مهمته حمل الناس وإلزامهم بكلامه وفتواه. الفتوي في بعض الأحيان تكون ملزمة إن صدرت من الحاكم العادل وللمصلحة العامة، ولحفظ مقدرات الأمة. الفتوي التي تخالف النصوص قطعية الثبوت والدلالة، وليست من باب الأحكام التي تتغير باطلة ولا يعتد بها.

This research, tagged with (rules of fatwas - models and applications), aims to clarify examples and examples of the many foundations and universals that the mufti and informant of the rule of God Almighty should know and accompany when issuing his fatwa and his statement of the rule of God Almighty for those who asked about it. Undoubtedly, this topic is of great importance, as it alerts that there are many rules and universals that are better, rather the mufti should know, observe and consider them when entering the chapter of fatwas, so that he presents the ruling of God Almighty with guidance and insight. This research came as models for these rules and colleges, by way of example but not limited to, and it included the most important three of those rules in the forms in which they were received with their explanation and clarification of their meaning and evidence, and mentioning examples, applications and branches based on them, and this research used the analytical method and concluded The important results are that: The fatw has rules, faculties, and controls that those who oppose the fatwa must be familiar with and consider them in his fatwa. The task of the mufti is to inform and explain the legal ruling, and it is not his task to carry people and obligate them with his words and fatwas. Sometimes a fatwa is binding if it is issued by a just ruler and in the public interest and the preservation of the nation. A fatwa that contradicts the texts is definitive and definitive, and it is not part of the rulings that change is invalid and is not taken into account. a base –– Fatwa - laboratory - binding – void.
