المستخلص: يخلق النظام الإتصالي اليوم، نمطاً من العيش الاجتماعي لم يعرف له العالم مثيلاً من قبل. فثورة الاتصال عن بعد، والتي توجت الثورة الرقمية، جعلت أنموذج شبكة العنكبوت ينتشر أفقياً ويحيط بكامل الكرة الأرضية. وإذا كان مجاز "الشبكة العنكبوتية" في عالم الطبيعة يقترن بإيحاءات في علاقة بالافتراس والصيد المتوحش لكل من يجرأ على المرور بين خيوط ومربعات "فضاء القبة الحريرية" فإن عالم الإنترنت بدوره لا يخلو من نفس الإيحاءات. فهو بقدر ما حررنا، ووضعنا فعلياً في مجاز "المجتمع المفتوح "the open society" أوقعنا في شباك الرقابة. وبقدر ما فتح عالم المعلومة وفتتها تحت أقدام "المدونين"، وضعها تحت سلطان توجيهه. وهو بقدر ما أعطى من حقوق النفاذ والملكية الفكرية، وفتح من آفاق التواصل، أنتج نقائض شديدة الذكاء والفاعلية والسيطرة والخنق. فهل يمكن أن نتحدث عن "مكر" للفضاء العمومي، و"شيطان" سلطاته الخفية؟ أم أن ما يحدث كان دائماً من جوهر صلب الفضاء العمومي، ونحن لا نفعل الآن سوى إعادة اكتشافه مرقمنا، وعلى نحو جديد؟ يسعى هذا المقال إلى تحليل هذه الإشكالية عبر توسل منهج تحليل النصوص المرجعية في هذا المجال الراهن جداً، لتفكيك آليات اشتغال الرقمي في علاقته بمفاهيم حقوق الإنسان.

The communicative system has recently created a social lifestyle that the world has never witnessed before. The telecommunications’ revolution, which culminated in the digital revolution, made the spider web model spread horizontally, thus surrounding the entire globe. While the “Web” metaphor in the natural world is coupled with connotations of predation and wild hunting of anyone who dares to pass between the threads and squares of the “silk dome space”, the Internet world actually shares such specifications. As long as it has liberated us in the context of the so-called “open society” it has doomed us into the censorship. The contemporary order of Communication produces extreme intelligence, effectiveness, control and restraints. In this vein, can we talk about such gloomy image of the public space, and the «demon» of his hidden powers? Has it always been the essence of the mainstream public space and whether we are merely rediscovering it in its digitized shape? This article seeks to broach this problem by analyzing references texts in this field so as to dismantle the workings of the digital system in relation to human rights concepts.

De nos jours, le système de communication crée un mode de vie social qui n’a jamais été vécu, en effet la révolution de la communication à distance et qui est l’aboutissement de la révolution numérique, a fait en sorte que le réseau de «la toile d’araignée» se transmet horizontalement et envahit la terre. Et si la toile d’araignée est étroitement lié dans notre imaginaire à la chasse sauvage, le réseau social d’internet répond aux mêmes significations, en effet l’internet nous a aussi bien libéré c’est-à-dire nous a mis dans une société ouverte et nous a piégé et nous a soumis sous contrôle, l’internet a autant bien facilité l’accès aux informations aux bloggeurs que protégé les droits de propriété intellectuelle. A cet égard peut-on parler de la diabolisation de l’internet ou bien considérer tout ça comme étant des faits normaux que nous redécouvrons l’aspect numérisé, cet article vise à analyser cette problématique à travers l’exploitation des textes de référence dans ce domaine à fin de déterminer les outils du fonctionnement numérique en relation avec les droits de l’homme.
