بعد التحول لاقتصاد السوق أبان المشرع الجزائري عن هدفه في تحسين مناخ الأعمال وتشجيع ازدهار المؤسسات خاصة مع بروز مؤشرات قوية على قيام أزمة اقتصادية جديدة، ولتجسيد ذلك بادر بإدخال إصلاحات نوعية مست المبدأ الأساسي المعتبر عنه بمبدأ حرية الاستثمار والتجارة، لتوسيع مجال نفاذ الاستثمارات الخاصة في الأنشطة الاقتصادية المختلفة، غير أن هذا التوسع رافقه تكريس لقيد عام يحد من مجال تدخل الأشخاص في أنشطة معينة وهو ما يؤثر سلبا على التنمية الاقتصادية الوطنية خاصة وأن المستثمرين الخواص يفضلون الاستثمار في الأسواق يتمتعون فيها بحرية المنافسة. After the transformation of the market economy, the Algerian legislator stated its goal to improve the business climate and encourage the prosperity of enterprises, especially with the emergence of strong indicators of a new economic crisis, To embody this, he initiated qualitative reforms that touched the fundamental principle expressed in the principle of freedom of investment and trade, to expand the scope of access to private investment in various economic activities. However, this expansion was accompanied by a dedication to a general restriction that limits the scope of people to engage in certain activities, which negatively affects national economic development, especially as private investors prefer to invest in markets where they enjoy freedom of competition. Après la transformation de l'économie de marché, le législateur algérien a mis en évidence son objectif d'améliorer le climat des affaires et d'encourager la prospérité des entreprises, notamment avec l'émergence d'indicateurs forts d'une nouvelle crise économique. Pour l'incarner, il a initié des réformes qualitatives qui ont touché le principe fondamental exprimé dans le principe de la liberté d'investissement et de commerce, pour élargir la portée de l'accès à l'investissement privé dans diverses activités économiques. Cependant, cette expansion s'est accompagnée de consacrer une restriction générale qui limite la portée des personnes à exercer certaines activités, ce qui affecte négativement le développement économique national, d'autant plus que les investisseurs privés préfèrent investir sur des marchés où ils jouissent d'une liberté de concurrence. |
