|d La justice pénale internationale représentée par la cour pénale internationale(CPI) est chargée de juger les responsables de crimes les plus graves ayant une portée internationale, et mettre fin aux massacres qui sont incompatibles avec la dignité humaine et droits de l'homme. mettre un terme à l'impunité aux auteurs des infractions internationales. Malgré son importance et son rôle au niveau international, un certain obstacles et défis auxquels la justice pénale internationale est confrontée. Posant la question sur la compétence et la capacité d'action de cette juridiction pénale internationale. Il s'agit d'une part, des obstacles relatif à l'impact de la souveraineté et l'opposition des Etats-Unis envers cette Cour. Enfin, la relation du conseil de sécurité avec la CPI et son influence sur la procédure de la cour.
