المستخلص: يعد عقد الصيانة الذي يرتب التزامات على عاتق الصائن واحد من اهم العقود في الحياة اليومية فهو عقد من العقود المهمة في الواقع العملي له خصائصه وصوره الخاصة به ولما كانت الآلات والأعيان لها دور مهم في حياة الأنسان فان الالتزام بصيانة تلك الأعيان يعد أمرا ضروريا من اجل أدامتها وصيانتها وأعادتها إلى حالتها المعهودة التي كانت عليها من قبل حصور الأعطال فيها فكان لنا أن نتناول تلك الالتزامات الملقاة على عاتق الصائن بشيء من التفصيل مبتعدين عن الإطالة والحشو معتمدين على أسلوب المقارنة واقتراح نصوص قانونية من اجل تنظيم تلك المسالة بشيء من التفصيل خاصة بعد غياب التنظيم القانوني الخاص بتلك المسألة فيوجب على الصائن بعد صيانة تلك الأعيان المتعاقد عليها وإنجاز تلك الأعمال حسب ما هو متفق عليه في العقد ما بين الطرفين والتزامه بالمحافظة على تلك الأعيان طيلة فترة الصيانة وأن يتوخى الحيطة والحذر عند القيام بالأعمال المكلف بها وعليه تسليم تلك الأعمال بعد الانتهاء من أعمال الصيانة خلال المدة المتفق عليها وعدم التأخير في إنجاز تلك الأعمال وأن يحافظ على سرية الأعمال المكلف بها عند صيانة تلك الأعيان منذ انعقاد العقد حتى بعد الانتهاء من تلك الأعمال وأن الأخلال بتلك الالتزامات هو أحد الأسباب الموجبة للمسؤولية العقدية، وبهذا انصب هذا البحث على تناول تلك الالتزامات بشيء من التفصيل لكي تصل إلى قواعد وأحكام تجعله يحظى بتنظيم قانوني خاص يلحق بركب بقية العقود التي وصلت إلى المرتبة التي تكفل لها التنظيم المفصل.
