|a هدف البحث إلى إبراز الجهود التي بذلها الإمام يحيى بن حمزة في حقل الاختلاف الفقهي، من خلال مقدماته الخمس لإعمال المسائل الفقهية في كتاب الانتصار، وحاول الباحث دراسة هذه الجهود دراسة نقدية؛ لإبراز قيمتها العلمية، وما أضافته لهذا العلم من جديد. وقد استخدم الباحث المنهج الاستقرائي الوصفي، إذ تم استقراء منهج الإمام يحيى بن حمزة لاستنباط الأحكام الفقهية وما يتفرع منها من قواعد. وخلص البحث إلى أن منهج المؤلف متنوع ومتعدد الجوانب، واستطاع بتفرد أن يبني منهجه بناء علميا وفنيا محكما، فضلا عن أنه استطاع أن ينهج منهجا جديدا لم يسبقه إليه أقرانه، وبرع في توظيف المعنى اللغوي لتقريب المعنى الفقهي والجمع في الاستدلال بين أدلة العقل والنقل، بأسلوب مترابط شيق ورصين. حتمت طبيعة البحث تقسيمه إلى مباحث ثلاثة فضلا عن المقدمة ثم النتائج والتوصيات، ففي المبحث الأول عرض الباحث مفهوم المقدمات وإعمال المسائل الفقهية، أما المبحث الثاني فقد خصص لدراسة السيرة الذاتية للإمام يحيى بن حمزة وكتابه الانتصار من حيث المميزات والمنهج، وأما المبحث الثالث فكان في دراسة المقدمات الخمس في كتاب الانتصار.

|b The aim of this research is to highlight the efforts made by Imam Yahya bin Hamza in the field of jurisprudence divergence through his five introductions to the realization of jurisprudential issues in the book of Victory. The researcher attempts to critically explore these efforts, to highlight their scientific value, and their contribution to this field of study. The researcher followed the inductive descriptive method through inductively exploring Imam Yahya bin Hamza approach to elicit jurisprudential rulings and the rules branching from them. The research concluded that the author’s approach is diverse and multifaceted, with a unique ability to build his approach on a tight scientific and technical basis. In addition, Imam Yahya was able to make a new approach preceding his peers, and employed the linguistic meaning to approximate the jurisprudential meaning, with combining inference between evidence of reason and transmission, in a smooth and solid style. The research is divided into three sections in addition to the introduction, the results and the recommendations. In the first section, the researcher presents Imam Yahya introductions and the implementation of jurisprudential issues. The second section is devoted to studying the biography of Imam Yahya bin Hamza and his book Al-Intisar (Victory) in terms of features and approach. While the third section is devoted to studying the five introductions in the book Al-Intisar.
