يهدف هذا البحث إلى دراسة الأحكام والمسائل الناظمة للمسؤولية الجزائية عن إساءة التخلص من النفايات الخطرة، والتي تشكل ضررا على البيئة ومكوناتها وصحة الإنسان، من خلال بيان مفهوم النفايات الخطرة، والأساليب الصحيحة للتخلص من النفايات الخطرة، وأساس التجريم والعقاب لهذه الجريمة، ثم بيان أركان جريمة إساءة التخلص من النفايات الخطرة، وإن كانت هذه الجريمة ليست من الجرائم المستحدثة إلا أن الأثر السلبي للمواد الخطرة في الوقت المعاصر أصبح أكثر تأثيرا على الأوساط البيئية والصحة العامة من ذي قبل؛ وذلك لازدياد المواد الخطرة التي يتم التخلص منها بطرق غير صحيحة، مما حدا بالمجتمع الدولي إلى وضع التدابير التشريعية للحد من تلك الجريمة، كاتفاقية بازل، وغيرها من الاتفاقيات والتشريعات التي تجاوزت مسائل التعويض عن الأضرار البيئية، إلى ترتيب المسؤولية الجزائية عن تلك الجريمة، من أجل ضبط معايير إدارة وتسيير النفايات الخطرة بما يتوافق مع الطرق الصحيحة للتخلص من النفايات الخطرة، بهدف حماية الأوساط البيئية.
This research aims to investigate the laws and provisions that regulate the criminal liability for the illegal disposal of hazardous wastes, which causes serious damage to the environment and its components as well as the human beings’ health. As the researcher has tackled it by identifying the concept of hazardous wastes, the correct methods of hazardous wastes disposal, the basis of incrimination and penalty for this offense, in addition to indicating the elements of the crime of illegal disposal of hazardous wastes. However, this crime is not one of the newly emerged crimes, the adverse effect of hazardous wastes has become more dangerous now on the environment and the general health than ever. This is due to the increase of the hazardous wastes that are disposed of inappropriately, which in turn has induced the international community to enact the necessary legislative measures to curb that crime, such as Basel Convention. As well as other conventions and legislations that went beyond the issues of compensation for environmental damages to the regulation of criminal liability for that crime, in order to set the criteria of managing and disposing of the hazardous wastes in line with the appropriate methods of the disposal of hazardous wastes in order to protect the environment
