المستخلص: La prolifération extraordinaire à l’échelle mondiale des accords commerciaux préférentiels, qui s’est accompagnée par une pléthore de régimes préférentiels et de procédés de détermination de l’origine des produits, a renforcé davantage la portée économique des règles d’origine (RDO) aussi bien pour les décideurs politiques que pour les autorités et opérateurs économiques chargés de leur mise en œuvre, devenue plus problématique face aux réalités de la mondialisation. Outils très subtils et extrêmement techniques, les règles d’origine se sont avérées, aujourd’hui, être un moyen efficace par lequel les pays filtrent l’accès à leurs marchés, en dépit de la libéralisation commerciale de façade, matérialisée par le biais des accords commerciaux préférentiels et des préférences commerciales qu’ils sont supposés accorder. Elles sont utilisées comme instrument de politique commerciale à des fins protectionnistes, expansionnistes et développementales. En d’autres mots, elles sont employées, par les gouvernements et les entreprises, pour obtenir les effets économiques et commerciaux souhaités.

The extraordinary worldwide proliferation of preferential trade agreements, which has been accompanied by a plethora of preferential regimes and processes for determining the origin of products, has further strengthened the economic significance of rules of origin (RDO) both for political decision-makers and for the authorities and economic operators responsible for their implementation, which has become more problematic in the face of the realities of globalization. Very subtle and extremely technical tools, rules of origin have today proven to be an effective means by which countries filter access to their markets, despite the facade of trade liberalization, materialized through preferential trade agreements and the trade preferences they are supposed to grant. They are used as an instrument of trade policy for protectionist, expansionist and developmental purposes.
