تناولت هذه الدراسة موضوع حوكمة الأوقاف، وقد حدد الباحث أهداف دراسته ببيان مفهوم الوقف وناظره في الشريعة الإسلامية، ثم بينه في النظام السعودي والقانون الأردني، ومن بعدها أوضح ماهية النظارة على الأوقاف وأنواعها في الشريعة الإسلامية، وعرضها في النظام السعودي والقانون الأردني، تبع هذا بيان مفهوم الحوكمة، وتوضيح أهميتها، وذكر أنواعها وخصائصها، والكشف عن مبادئها ومجالاتها، وصولا إلى أثرها في تنظيم الأوقاف، وتحقيق الغاية منها في الشريعة الإسلامية والنظام السعودي والقانون الأردني. وقد انتهج الباحث في الإجابة عن تساؤلات الدراسة المنهج الوصفي بطريقته العلمية القائمة على الاستقراء والتحليل والمقارنة، من خلال تتبع حقائق الموضوع، وجزئياته، من مصادره في الفقه الإسلامي، والنظام السعودي، ومواد القانون الأردني المعنية بشؤون الوقف عموما، وبالحوكمة على وجه الخصوص، مع التأصيل الشرعي والقانوني لمسائل الدراسة. ويمكن إيجاز أبرز ما توصل إليه الباحث في هذه الدراسة من نتائج في النقاط الآتية: 1.يرجع تاريخ الوقف إلى فجر الإسلام، وقد دلت على مشروعيته نصوص الكتاب والسنة والإجماع، ويتوافق الوقف مع مقاصد الشريعة، فهو معقول المعنى مصلحي الغرض. 2. راعت الشريعة نفع المتعدي، وزادت أهميته مع تزايد حاجات المجتمعات الإسلامية، مما أبرز أهمية صياغة وثيقة الوقف في تحديد مصارف تواكب حاجة المسلمين، تتكيف مع اختلاف الأزمنة، وضبط الوثيقة يكون باستشارة المخصصين. 3.ظهرت أهمية تنمية الوقف وعظم مسؤولية الناظر في أن يحسن الاختيار، فالوقف أريد منه الدوام لا الانقطاع، وهذا يتطلب مع الواقف أن يحسن اختيار نظار وقفه. 4.ثقل مسؤولية الناظر وحساسية عمله، فالناظر هو عين الواقف على وقفه، وأمينة في تنفيذ مقصودة من وقفه، ولابد من اهتمام الواقفين والنظار بالتطوير والتدريب التي تزيد النظارة كفاءة وإتقانا، كي يعود على الوقف بالبناء والتميز.
This study addresses Awqaf governance that aims at representing the concept of Waqf in law and Islamic shariah, Saudi legal system and Jordanian laws; superintendent over Awqaf and its types according to Islamic shariah as well as the Saudi legal system and Jordanian laws; the concept of governance, its importance, types, characteristics, in addition to principles and areas of governance, its role in operating Awqaf and fulfilling its purpose according to Islamic shariah, Saudi legal system and Jordanian law. The researcher, in its quest for answering the research questions, has adopted the descriptive approach which based on induction, analysis and comparison through tracing the facts of the subject matter from Islamic shariah references, Saudi legal systems and articles of Jordanian law regarding Awqaf in general and governance in particular; in addition to tracing its roots in shariah and laws. The research outcomes can be summarized through the following points: 1.Waqf dates back to the beginning of Islam. Religious texts, sunnah refers to the permissibility of waqf by consensus. It lies in conformity with shariah; it is logical and purpose-built. 2.Shariah gives concern to the non-exclusive benefit and increases its importance as of the growing needs of Islamic communities, which in turn highlight the importance of drafting the deed of Waqf to represent its spending channels to ensure that they meet the need of Muslims and suit the element of time variance. The governance of Waqf deed shall be carried out based on specialists’ consultants. 3.Also, the importance of developing waqf and the great responsibility of superintendent regarding the good management of waqf has been highly reflected and highlighted. Waqf supposed to always keep generating profit. So, the endower has to appoint good superintendents. 4There is a great responsibility on the superintendent due to the sensitive nature of his job. Superintendent is the eye of endower on waqf and its secretary that has to meet the purposes of waqf. Both endowers and superintendent have to give attention to the development and trainings matters that in turn increase the efficiency and coherence of
