|a هذه الدراسة حول الأدب بالاجتهاد والتعزير في المذهب المالكي كدراسة اصطلاحية من أهم أهدافها: الكشف عن العلاقة بين المصطلحين وهل بينهما تغاير في الاستخدام أم ترادف، وللوقوف على ذلك تبحث الدراسة في حدود المصطلحين في المذهب، وفي مجالات استخدامهما في المذهب وفيما تتم به هذه العقوبة من أجناس، وقد سلكت الدراسة المنهج الاستقرائي والتحليلي، وخلصت إلى جملة من النتائج أهمها: أن المالكية استخدموا المصطلحين استخدام ترادف ولا فرق عندهم بينهما، كما شملت توصيات من أبرزها: امتداد الدراسات المصطلحية ودراسة التعزير بالمال، والتعزير بالقتل، ومجالات التعزير.

|b This is a study entitled: (Literature by Ijtihad and reinforcements in the Maliki School is an idiomatic study). One of the most important objectives of the study: To reveal the relationship between the two terms and whether there is a difference between them in use or a synonym, and to find out that the study examines the limits of the terms in the doctrine, and in the areas of their use in the doctrine and in what is done By this punishment of genera, the study followed the inductive and analytical method, and concluded a set of results, the most important of which are: Maliki used the two terms using a synonym and had no difference between them, as it included recommendations of the most prominent of them: the extension of terminology studies.
