|a تعتبر المساعدات الإنسانية من أوكد الحقوق التي تجب لضحايا النزاعات المسلحة والكوارث الطبيعية، لأنها عمل حيادي بطبيعته، فهي موجهة للمدنيين، وهذا أمر تعترف به كل الدول تقريبا التي صدقت على اتفاقيات جنيف الأربع لاسيما إذا كان الأمر يتعلق بالنزاعات المسلحة ذات الطابع الدولي التي لاتثير نزاعا في تطبيقها والامتثال لأحكامها، بعكس النزاعات الداخلية التي تثير الحساسية والمخاوف لديها من امتهان سيادتها. ولأمر ليس مقصورا على الدول وحدها، بل حتى مجلس الأمن متهم بالمحاباة وتسييس حقوق الإنسان، وهذا يعتبر انتهاكا لمبادئ القانون الدولي الإنساني ومبادئ العمل الإنساني معا، إذ هما يقومان على ذات الأرضية التي تتشكل من الإنسانية والحياد وعدم التمييز.

|b Humanitarian aid is an inalienable right of civilians who are victims of armed conflicts and natural disasters, especially if the issue is related to international armed conflicts that do not raise conflict in their application and compliance with their provisions, unlike internal conflicts that raise sensitivity and the fears of being exposed to the sovereignty of the state. This matter is witnessing deficiencies on the part of some countries and some international organizations such as the Security Council accused of favoritism and politicization, and this is considered a violation of the principles of international humanitarian law and collective humanitarian. Action together, as they are based on the same ground that is made up of humanity, neutrality and non-discrimination.
