المستخلص: يمارس مجلس شورى الدولة اختصاصه الاستشاري من خلال إصدار الفتاوى والآراء القانونية للوزارات والجهات غير المرتبطة بوزارة وتتولى هذه المهمة الهيئات الاستشارية وهي كل من الهيئة العامة وهيئة الرئاسة والهيئة المتخصصة. إذ إن الهيئات الاستشارية أنفة الذكر تمارس اختصاصات مختلفة في مجال التقنين وفي مجال إبداء الرأي القانوني وتقديم المشورة القانونية. وقد استطاع مجلس شورى الدولة من خلال ممارسة اختصاصه الاستشاري أن يوفر حماية للحقوق والحريات العامة، إذ ساهم في حماية الحقوق والحريات الشخصية من خلال إصدار الفتاوى التي تنص على عدم جواز حجز الأفراد دون قرار قضائي وتعطيل التشريعات التي صدرت في زمن النظام السابق والتي كانت تمنح أعضاء في السلطة التنفيذية كالوزراء والمحافظين صلاحية حجز الأفراد بقرار إداري، كما ساهم المجلس في حماية الحقوق والحريات الفكرية من خلال إفتائه باحترام الحرية الدينية وحق التعليم. وكان للمجلس دور في حماية الحقوق والحريات الاقتصادية من خلال إصدار العديد من الفتاوى بشأن حماية حق الملكية والتأكيد على احترام هذا الحق من خلال منع رئيس السلطة التنفيذية من إصدار أوامر إدارية بحجز عقارات الأفراد دون صدور حكم قضائي، وكذلك ساهم المجلس في حماية حرية التجارة من خلال الإفتاء بحرية تأسيس الشركات التي تعمل في مجال تشغيل العمال دون استحصال موافقة الجهة القطاعية. وأخيرا لعب المجلس دور في حماية الحقوق والحريات الاجتماعية من خلال إصدار الفتاوى التي تحمي حق العمل وحق العامل في الحصول على الأجر المناسب وما يعد من متممات الأجر كالإكرامية.

The State Legislative Council practices its consultative specialization through issuing the fatwas and legal opinions for the ministries and the institutions which are not associated with a ministry, The Advisory Commissions with each of General Commission, Presidency Commission and The Specialized Commission take charge of this mission. Where the abovementioned Advisory Commissions practice different jurisdictions in codification field, giving legal opinion field and legal advisory. The State Legislative Council through its Advisory specialization could provide a protection for the rights and general freedoms where it contributed in protecting the rights and personal freedoms through issuing the fatwas that dictates to that impermissible to sequester individuals without Judgment Decision and disable the legislations that issued in the era of the previous regime which granted members in the Executive authority like ministries and governors the authority to sequester individuals with an administrative decision, the council also contributed in protecting the rights and intellectual freedoms through its fatwa to respect the religious freedom and teaching right. The council had a role of protecting the rights and economic freedoms issuing many fatwas about the operation of transferring the property and affirming to respect this right through preventing the Head of the Executive authority from issuing administrative decisions of sequestering the individuals real estates without issuing Judgment Decision, the council also contributed with protecting the trade by the fatwa of the permit to establish companies that works in employing workers without the agreement of the sector authority. Finally, the council played a role in protecting the rights and social freedoms through issuing the fatwas that protect the work right and the worker right in getting the suitable wage and other wages like the bonus.
