المستخلص: إن الصلح الواقي من الإفلاس لا يصبح ملزما لأطرافه بالرغم من موافقة المدين عليه وغالبية الدائنين إلا بتصديق المحكمة عليه، فبمجرد التصديق يصبح نافذا وينتج آثاره. حيث يلتزم المدين التاجر بتنفيذ شروط الصلح التي تم الاتفاق عليها بجمعية الصلح، شخصا طبيعيا كان أم شركة، كما أن سريان الصلح يمنع المدين من طلب صلح آخر ويمنع أيضا الملتزمين مع المدين بالوفاء من الاستفادة بشروط الصلح. بيد أن الشركاء في الشركة المسؤولون في جميع أموالهم عن ديونها تسري عليهم آثار الصلح الواقي فيستفيدون من شروط الصلح الواقي، هذا بالنسبة للمدين والملتزمين مع المدين. أما الدائنون الذين تسري عليهم شروط الصلح الواقي كاثرا من آثار التصديق عليه فهم جميع الدائنين العاديين الذين نشأت ديونهم قبل صدور حكم افتتاح إجراءات الصلح وقبلت بصورة نهائية أو مؤقتة ولو لم يشتركوا في إجراءاته أو لم يوافقوا عليه.

The preventive composition of bankruptcy does not become binding on its parties despite the consent of the debtor and majority of creditors shall only ratify by the court, once the ratification becomes effective and produces its effects, the trader debtor must commit to the terms of the conciliation agreed upon by the conciliation society, a natural person or company, the validity of conciliation prevents the debtor from requesting another composition and also prevents those who commits with the debtor to fulfil the benefit of the conditions of the composition. However, the partners in the company who are responsible for all of their money for its debts are subject to the effects of a protective settlement and will benefit from the conditions of the composition, for the debtor and those who are bond by the debtor to fulfil. As for the creditors who are subject to the terms of the composition as a consequence of the ratification of the preventive composition they are all the ordinary creditors whom debts are aroused before the opening of the conciliation proceedings and their debts are accepted, either definitively or temporarily, even if they did not participate in the proceedings or did not agree upon them.
