|a يعد منح الحقوق، لاسيما الإجرائية، للضحايا أمام المحكمة الجنائية الدولية (ICC) خروجا أساسيا عن المحاكم الجنائية دولية، سواء (المحاكم العسكرية المؤقتة أو المختلطة)، ولأول مرة في تاريخ العدالة الجنائية الدولية، يمكن للضحايا المشاركة في إجراءات جبر الضرر أمام المحكمة الجنائية الدولية إذ يمكنهم التعبير عن وجهه نظرهم وشواغلهم في كافة مراحل الإجراءات، إذ جعل نظام روما الأساسي لعام 1998، الضحية طرفا فاعلا في إجراءات المحكمة من خلال الاعتراف بعدد من الحقوق، مثل الحق في المشاركة في المحاكمة، والحق في الحماية، والحق في التمثيل القانوني، وكذلك الحق في جبر الضرر أو التعويض.
