المستخلص: يهدف بحثنا الراهن إلى مواجهة بعض صور الجرائم الاقتصادية، ومنها جرائم تقليد وتزييف العُملة كدراسة مقارنة، فالعُملة لها قيمة وأهمية خاصة للأمم والمجتمعات، وأن ارتكاب جرائم العُملة لها آثار سلبية تنعكس على المجتمع، لذلك جرم المشرع كل اعتداء يقع عليها، سواء تقليداً أو تزويراً أو تزييفاً أو إدخال العُملة المقلدة أو المزيفة وإخراجها أو ترويج العُملة المقلدة أو المزيفة أو الحيازة بقصد التعامل. وسوف نتناوله في ثلاثة مباحث، تعرضنا في المبحث الأول لماهية جرائم تزييف وتقليد العُملة وآثارها، في المطلب الأول التعريف بالتزييف والتقليد وفي المطلب الثاني آثار جرائم تزييف العملة، أما المبحث الثاني أركان جرائم تقليد وتزييف العملة في المطلب الأول: الركن المادي لجرائم تقليد وتزييف العُملة، وفي المطلب الثاني الركن المعنوي لجرائم تقليد وتزييف العُملة، وأما المبحث الثالث: الجزاءات الجنائية على جرائم تزييف وتقليد العُملة ، نناقش فيه جنايات جرائم تقليد أو تزوير أو تزييف العُملة، وكذلك جنح هذه الجرائم، وموقف بعض التشريعات من ذلك سواء التشريع المصري والعراقي والجزائري والفرنسي، وفي نهاية البحث أوردنا خاتمة تتضمن النتائج المتوصل إليها، والتوصيات المرجوة من وراء الإقدام على هذا البحث.

Our current research aims to confront some forms of economic crimes, including crimes of counterfeiting and counterfeiting currency as a comparative study, because the currency has a special value and importance for nations and societies, and that the commission of currency crimes has negative effects that are reflected on society, so the legislator has committed an offense against it, whether imitation, forgery or Counterfeiting, inserting the counterfeit or counterfeit currency and taking it out, or promoting the counterfeit or counterfeit currency or possession with the intention of dealing. We will deal with it in three sections, in the first section we dealt with the crimes of counterfeiting and counterfeiting currency and their effects, in the first requirement the definition of counterfeiting and counterfeiting, and in the second to the effects of counterfeiting crimes, and in the second topic the elements of counterfeiting and counterfeiting crimes in the first requirement: the material element of the crimes of counterfeiting and counterfeiting currency, In the second request, the moral element of counterfeiting and counterfeiting currency crimes, and as for the third topic: Criminal penalties for the crimes of counterfeiting and counterfeiting currency, we discuss felonies of counterfeiting, forgery or counterfeiting of currency, as well as misdemeanor of these crimes, and the position of some legislation on that, whether in Egyptian, Iraqi, Algerian and French legislation, At the end of the research, we included a conclusion that includes the findings and recommendations for undertaking this research.
