المستخلص: تنطلق هذه الدراسة من هدفين رئيسين هما التعرف على طريقة تسجيل وثيقة إشهاد شرعي على أربعة تصرفات في مجلس عقد واحد، هذه التصرفات هي رهن أرض ملك حسين باشا فاضل يكن وأخيه إبراهيم توفيق باشا، وحوالة دين، ورهن أرض ملك حسين باشا فاضل، وتفاسخ عقد رهن سابق للأرض المرهونة نفسها للراهنين، وتحقيق هذا الهدف يتطلب إقامة النص، وتحليل الخصائص الداخلية والخارجية لتلك الوثيقة؛ والتعرف على مدى التشابه والاختلاف بين أجزاء وصيغ الوثيقة وبين الأجزاء والصيغ التي وضعها الشرطيون والموثقون، وهذا يتطلب المقارنة بين نص الوثيقة والقواعد التي وضعها الشرطيون والموثقين، والهدف الثاني استنباط قواعد كتابة أكثر من تصرف في ورقة واحدة، وقد استخدم البحث لتحقيق هذه الأهداف المنهج التاريخي، ومنهج دراسة الحالة.

This study proceeds from two main objectives: to identify the method of recording a witness document on four actions in one contract council. These actions are the mortgage of the land owned by Hussein Pasha Fadil and his brother Ibrahim Tawfik Pasha, and the mortgage transfer, the mortgage of the land owned by Hussein Pasha Fadil, and the avoidance of a previous mortgage contract for the same land encumbered by the betters, and achieving this goal requires construction of the text, and analysis of the internal and external characteristics of that document; and identify the similarities and differences between the parts and formats of the document and between the parts and formats developed by police and notaries. This requires a comparison between the text of the document and the rules developed by police and notaries. The second objective is to adopt the rules of writing more than one act in one paper, To achieve these objectives, the research has used the historical approach and the case study approach.
