المستخلص: إن الحنفية أكثر المذاهب الفقهية أخذا بالحيل كما هو موجود في كتبهم، ولكن قولهم بالحيل جاء محددا بضوابط شرعية، يلاحظ من تقسيماتهم للحيل، فليست كل حيلة هي مباحة عند الحنفية؛ لأنهم حرموا كل حيلة لا يتوصل بها إلى الحق. فلابد في الحيل عند الحنفية أن يتوصل بها إلى الحق، وتتفق مع قيودهم التي قيدوا بها العقود، وتتفق مع مقاصد الشريعة، فالحيل عندهم لم يقصد بها التوصل إلى الحرام، بل قصد بها التيسير والتخفيف، فالحيلة عند الحنفية بمعنى المخرج. لذا لا يعاب على الحنفية أخذهم بالحيل؛ لأنها لم يقصد بها هدم مقاصد الشارع وتفويت أحكامه، وإنما هي وسيلة لتيسير الحياة العملية، فضلا أن للحنفية أدلتهم من الكتاب والسنة والقياس والمعقول. كما لا يخفي إن ما ورد من حيل محرمة عن الحنفية، قول غير صحيح، فهي إما حيل نسبت إليهم، أو ثبت إنهم تراجعوا عن القول بها؛ لذا يجب تبرئة ساحتهم منها.

The Hanafi school of jurisprudence is the most likely to take tricks as it is found in their books, but their saying of tricks came with legal controls. It is noted from their divisions of tricks, not every trick is permissible according to the Hanafis; Because they have forbidden every trick that does not reach the rightness. According to the Hanafis, the tricks must reach the truth, and they must agree with the restrictions by which they restricted contracts and agree with the purposes of Sharia. For them, tricks are not intended to reach the forbidden but rather to facilitate and mitigate. So, the trick, according to the Hanafis, means the exit. Therefore, the Hanafis are not blamed for using tricks; Because it is not intended to destroy the purposes of the Lawmaker and to miss its provisions, but rather it is a means to facilitate practical life, in addition to the fact that the Hanafis have their evidence from the Qur’an, Sunnah, analogy and reasonableness. It is also not hidden that the forbidden tricks of the Hanafi school are incorrect because either those tricks are attributed to them, or it has been proven that they have retracted their statement, So, they must be acquitted of it.
