المستخلص: نشأت فكرة حقوق الإنسان وتطورت في النظم الداخلية، حيث بدأت مع بداية القرن العشرين تنتقل بالتدريج نحو أفق واسعة لتدخل في حيز نظام القانون الدولي. ولم يكن هذا الأمر بالهين في الحقيقة وذلك لرسوخ مبدأ السيادة في العلاقات الدولية، إلا أن الحرب العالمية الثانية والويلات والجرائم التي ذاقتها الإنسانية كانت حافزا مهما في تدوين حقوق الإنسان وتقنينها واعتراف المجتمع الدولي بها. حيث ساعد امتداد جذور حقوق الإنسان في كل مكان من العالم من خلال الأنماط المتعددة للسلطات والأنظمة السياسية التي يختص بها كل مجتمع انتشار الوعي بين عموم الشعب، وزاد تأثير الأفكار الفلسفية التي نودي بها في كلا من الثورة الفرنسية والأمريكية في ظهور مجموعة من المواثيق الدولية التي تختص وتهتم بمسائل حقوق الإنسان وحرياته وآليات حمايتها من أي انتهاك. يهدف هذا البحث إلى إيجاد توصيات تساعد في النهوض بحقوق الإنسان وتقليل انتهاكها بأكبر قدر ممكن، كما يمكن تلخيص أهم نتائجه في التالي: 1-الحضارات القديمة ساهمت بشكل كبير وواضح في بلورة حقوق الإنسان، حيث أن لتلك الحضارات الفضل في ترك الأفكار الفلسفية في مجال حقوق الإنسان، كما وأنها ابتدعت مفاهيم قانونية دقيقة تختص بصون حقوق الإنسان وحرياته ومن أهمها فكرة الديموقراطية وهي من أهم الأفكار التي تركتها الحضارات القديمة لنا. 2-أخذ حقوق مواضيع حقوق الإنسان وحرياته حيز كبير من الاهتمام المتزايد والمتصاعد على مستوى الصعيد الدولي حيث أن صدور العديد من المواثيق الدولية وتضمينها المبادئ الأساسية لحقوق الإنسان ساهمت في تطوير صورها ووسائل حمايتها. 3-وجود اختلاف وتفاوت شاسع في درجات الاهتمام والتقدم والتطور بحقوق الإنسان وحرياته الأساسية بين الدول. 4-بالرغم من تكاثف الجهود الدولية في حماية حقوق الإنسان ووضع آليات حمايتها إلا أن العالم لا يزال يشهد انتهاكات جسيمة ضد هذه الحقوق حتى يومنا هذا وذلك بسبب أن الدول لا تلتزم دائما باحترام حقوق الإنسان وحرياته وليس فقط في الدول النامية بل أن هناك نماذج من الدول المتقدمة أيضا. بذلك أصبح موضوع الحماية الدولية لحقوق الإنسان من أهم المواضيع التي تشغل حيزا ليس ببسيط في المجتمع الدولي والقانون الدولي.

The idea of human rights originated and evolved in the internal systems, where by the beginning of the twentieth century began to gradually move to a broad horizon to enter the system of international law. This has not been an easy task to promote the principle of sovereignty in international relations. The spread of human rights everywhere in the world through the various types of authorities and political systems of each society helped spread awareness among the general public, and increased the influence of philosophical ideas advocated in both the French and American revolution in the emergence of a set of international conventions that specialize It is concerned with the issues of human rights and freedoms and the mechanisms to protect them from any violation. The aim of this research is to find recommendations that help promote human rights and minimize their violations. The main findings can be summarized as follows: 1) Ancient civilizations have contributed significantly and clearly to the crystallization of human rights, as those civilizations have the credit to leave philosophical ideas in the field of human rights, and they have created precise legal concepts specializing in the protection of human rights and freedoms, the most important idea of democracy, one of the most important ideas left by ancient civilizations Our. 2) Taking the rights and freedoms of human rights subjects into a growing and increasing interest at the international level, where the issuance of many international conventions and the incorporation of the basic principles of human rights contributed to the development of their forms and means of protection. 3) There is a wide difference in the degree of interest, progress and development of human rights and fundamental freedoms between countries. 4) Despite the intensification of international efforts in the protection of human rights and the establishment of mechanisms to protect them, the world is still witnessing serious violations against these rights to this day because of the fact that States are not always committed to respect for human rights and freedoms, not only in developing countries, but there are models of states Also advanced. Thus, the issue of international protection of human rights has become one of the most important issues that occupy a simple space in the international community and international law.
