المستخلص: موضوع البحث: الاستشكالات التي أوردها بدر الدين الزركشي في كتابه (البحر المحيط في أصول الفقه)، حيث تميز بذكر الاستشكالات أو نقلها والإجابة عنها في الكثير من المسائل الأصولية. أهداف البحث: تتمثل في محاولة تأصيل الاستشكال، من حيث وضع تعريف له وبيان صيغه ومحله والقائم به والجواب عليه، وكذلك أثره على المسائل الأصولية، وبيان الطرق المثلى لإزالة الاستشكال. منهج البحث: الطريقة العلمية التي تجمع بين الاستقراء والاستنتاج. أهم النتائج: أن الاستشكال في علم الأصول جدير بالبحث من حيث التأصيل حيث لم يحظ بذلك من قبل، وأن للاستشكال أثره في تقرير بعض مسائل الأصول، وأن بعض الأصوليين امتاز عن غيره بكثرة ذكر الاستشكالات ومناقشتها.

The subject of this research is the ambiguities mentioned by Badr al-Din al-Zarkashi in his book "The "Albahr Al- Mohyt" in the Origins of Jurisprudence", which is characterized by the mention of ambiguities or their transfer and response to many fundamental issues. The objectives of this research are to attempt to root out the ambiguity, in terms of setting a definition, a statement of its wording, its place, its author and the answer to it, as well as its impact on fundamental issues, and the best ways to remove the ambiguity. The research approach is the scientific method that combines the induction and the conclusion. The most important result of this research is that the ambiguity of the Jurisprudence is worthy of research in terms of rooting where it has not been previously, and that the form of the ambiguity in the determination of some of the issues of the Jurisprudence, and that some of the fundamentalists are very different from the mention and discussion of the ambiguities. One of the recommendations of this research is the independence of research in rooting the issue of the fundamentalists, and the collection and study of the ambiguities that arise in the Jurisprudence.
