تأتي هذه الدراسة لتظهر جانبا من منهجية القاضي أبي يعلى الفقهية، وتكشف عن مقامه في مذهب الإمام أحمد، وتأثيره فيه، وتبرز اختصاصه بروايات الإمام، ومنهجيته في معالجتها. فقدمت بما يكشف عن منهجيته في فقهه واجتهاده وطرائقه في تأليفه ومصنفاته، ونبهت على تأثر القاضي ومدوناته بمتقدمي الأصحاب وفقهاء العراق في عصره، وكشفت عن طرف من آلياته في معالجة نصوص الإمام أحمد، ثم حاولت إبراز أثر معالجاته لروايات الإمام أحمد ونصوصه، وتخريجاته عليها واحتمالاته على الأقوال في المذهب، من توسيع فروعه وأقواله، وإسهامها في بنائه وتشكله. وموقف الأصحاب منها، وطرائقهم في التعامل معها. كما أنها كشفت عن بعض عوائده في معالجته هذه؛ كجمعه بين ما أمكن الجمع بينه من روايات الإمام، والآليات التي استعملها في عادته هذه، وجادَّته في التخريج والاحتمال على روايات الإمام أحمد، وتأثيرها على فروع المذهب. ثم حاولتْ التماس أهم مثارات تغليط الأصحاب له، وأبرزت بعض مظاهر ممارساتهم النقدية لمنقولاته عن الإمام أحمد، وتأويلاته لنصوصه، وأشارتْ إلى تحريرهم لاختياراته وأقواله الفقهية، وتقويمهم لحكاياته عن متقدميهم.
This study is conducted to show one aspect of Judge Abu Ya’la’s Fiqhi approach and his position and impact on the school of Imam Ahmed, highlighting his interest and approach in examining the narrations of Imam Ahmed. Therefore, I attempted to probe his approach in his approach to Fiqh, his personal judgement, and methods of his books and compilations. I noted that he is influenced by his predecessors and Iraqi scholars of Fiqh during his time. I also discussed his mechanisms for examining Imam Ahmed’s texts and narration. I tried to highlight the impact of his work and his extrapolations and ideas about the different opinions of the school by extending the sub-principles and opinions and how they are employed in structuring the school, in addition to the opinions and approaches of the patrons of the school. This study explores some of his traditions in this regard like his collection of Imam’s narrations thematically and the mechanisms used in this procedure, his diligence in extrapolation of Imam Ahmed’s narration, and its impact on the school sub-principles. Finally, I pursued the points raised by the school patrons about his faults, highlighting their critical views of his quotations of Imam Ahmed and his interpretation of Imam’s texts. I pointed to some instances of their reviewing his fiqhi opinions and evaluating his narratives about the predecessors.
