المستخلص: يهدف البحث إلى دراسة حقوق كبار السن وآليات حمايتها في ضوء قواعد القانون الدولي وفي ظل التنامي المرتفع لأعدادهم وما صاحبه من ارتفاع الإساءات الموجهة إليهم وفق ما أشارت إليه تقارير الأمم المتحدة، ومدى الحاجة إلى وجود صك دولي ينظم هذه الحقوق ويوفر الحماية الدولية لها، وخاصة في ظل الأزمات الطارئة ومن بينها جائحة كورونا. ويتناول البحث عدة موضوعات من بينها: ماهية كبار السن وأهمية رعايتهم وأشكال الإساءة الموجهة إليهم، والتحديات التي تواجههم، وما مدى الحاجة إلى وجود صك دولي يكرس لحمايتهم في ظل عدم وجود وثيقة دولية ملزمة توفر لهم الحماية وتحفظ لهم حقوقهم باعتبارهم من أكثر الفئات الآخذة في الازدياد، وخاصة في الآونة الأخيرة في ظل جائحة كورونا التي طالت حتى الرئيس الأمريكي دونالد ترمب البالغ من العمر 74 عاما. خلص البحث إلى كثرة الإساءات الموجهة لكبار السن في ظل ازدياد الفقر وارتفاع نسبة كبار السن وخاصة في الدول النامية، وأن قواعد القانون الدولي لحقوق الإنسان القائمة توفر الحماية القانونية ضمن القواعد العامة غير أن قواعد الحماية هذه غير كافية، وهو ما يتطلب ضرورة إصدار صك دولي ملزم يتعلق بكبار السن ينص على حقوقهم ويوفر الحماية الدولية لهم وبما يحفظ لهم كرامتهم، وخاصة في ظل جائحة كورونا التي ازدادت فيها الإساءات الموجهة إليهم.

The research aims to study the rights of the elderly and their protection mechanisms in light of the rules of international law and especially in the high growth of their numbers and the accompanying high abuses against them according to what the United Nations reports indicated. Thus, the need for an international instrument that organizes these rights and provides international protection for them increased, especially in emergency crises, such as the Corona pandemic. The research deals with several topics, including: what the elderly are, the importance of caring for them, the forms of abuse directed at them, the challenges they face, and the extent of the need for an international instrument devoted to their protection in the absence of a binding international document that provides them with protection and preserves their rights as they are among the most growing groups. Especially due to the Corona pandemic that affected even the 74- year-old US President Donald Trump. The research concluded that there is a great deal of abuse directed at the elderly because of the increase in both poverty and the proportion of the elderly, especially in developing countries. The existing rules of international human rights law provide legal protection within the general rules, but these protection rules are insufficient, which requires the need to issue a binding international instrument. It is related to the elderly, stipulating their rights and providing them with international protection in a way that preserves their dignity, especially in light of the Corona pandemic, in which the abuse directed against them increased.
