المستخلص: تعتبر الدساتير حجر الزاوية في بناء الدول القانونية فهي ضرورة اجتماعية لتحقيق الاستقرار، فمن غير المتصور وجود دولة بدون دستور إذ يتصدر قواعده وأحكامه وغيرها من القواعد القانونية الأدنى مرتبة كالقوانين واللوائح الإدارية السبق في ضوع التنظيمات القانونية لحقوق وحريات الأفراد- ويتعين أن تجري أعمال وتصرفات السلطات في دائرة هذه القواعد التزاما بمبدأ سمو الدستور وعلوه بحيث يتقيد التشريع الأدنى بالتشريع الأعلى. ونظرا لما تحظى به الدساتير من احترام وقدسية، فإن الشعوب عادة ما تحرص على أن تسجل بين نصوصها حقوقها من أجل الحصول عليها.
ولذلك حرص الدستور المصري الصادر عام 2014م وقليل جدا من دساتير العالم على عدم التمييز على أساس الإعاقة وهذ يحمد للدستور المصري، لأن المعاق ليس معاقا بذاته بل المجتمع الذي يعيش فيه هو الذي أعاقه، لأن تقاس المجتمعات في درجة رقيها وتطورها بدرجة اهتمامها بذوي الإعاقة ليس كأطراف مستضعفين في الأرض، بل باعتبارهم بشر يجب الحفاظ على كرامتهم الإنساني والعمل على اندماجهم في المجتمع، لأن الإعاقة سيصاب بها كل إنسان في مرحلة ما من حياته سواء بصفة دائمة أو مؤقتة، لذا يجب على المجتمع وضع العديد من الضمانات وبذل المزيد من الجهود من أجل إزالة جميع العقبات التي تفرق بين المعاقين وغيرهم وإجبارهم في غالب الأحيان على البقاء على هامش المجتمع.

It is unimaginable to have a state without a constitution, as its rules and provisions and other lower legal rules such as laws and administrative regulations take precedence over the legal arrangements for the rights and freedoms of individuals- and the actions and actions of the authorities must take place in The circle of these rules is in compliance with the principle of the supremacy of the constitution and its superiority, whereby the minimum legislation adheres to the supreme legislation. Due to the respect and sanctity of constitutions, people are usually keen to register their rights in their texts in order to obtain them.
That is why the Egyptian constitution issued in 2014 and very few constitutions of the world was keen not to discriminate on the basis of disability, and this praises the Egyptian constitution, because the disabled is not a handicapped in itself, but the society in which he lives is the one who hindered him, because societies are measured in the degree of their advancement and development by the degree of their concern for people with disabilities, not as parties. The vulnerable people on earth, but as human beings must preserve their human dignity and work to integrate them into society, because disability will afflict every person at some point in his life, whether permanently or temporarily, so society must put in place many guarantees and make more efforts to remove All the obstacles that separate the handicapped from others, forcing them in most cases to remain on the margins of society.
