المستخلص: العلاقة بين حقوق ذوي الإعاقة البصرية وحقوق المؤلف، حيث أصبح تقدم الأمم يقاس بما تقدمه من خدمات لذوي الإعاقة في مجتمعاتها، بل وتميز العقد الأخير بوجود ضابط جديد لقياس المفهوم العالمي الجديد الذي أطلق عليه التنمية المستدامة، وهو قياس مدي اندماج ذوي الإعاقة في مجتمعاتهم، ومدي ما يقدمونه أنفسهم من إسهام في تقدم مجتمعاتهم، وبذلك أصبح الاهتمام بشئون ذوي الإعاقة البصرية ذا وجهين غير منفصلين بل يتكامل أحدهما مع الأخر، الأول تقديم الخدمات الخاصة بهم ومدي اندماجهم في المجتمع، والثاني دور ذوي الإعاقة أو ما يقدمه ذوي الإعاقة لمجتمعاتهم في إطار ما يسمي بالتنمية المستدامة. وباعتبار أن العلاقة بين الحقوق تتقاطع في دوائر قد تؤدي في بعض الأحيان إلى أعمال حقوق على حساب أخري، فإن البحث الماثل يعني بتحدي إطار لطبيعة العلاقة بين حقوق ذوي الإعاقة البصرية وحقوق المؤلف، حيث أن حقوق المؤلف قد تمثل العقبة الكئود في طريق ذوي الإعاقة البصرية في سبيلهم للحصول على حقوقهم، وبالتالي في سبيل دمجهم بمجتمعاتهم، والاستفادة من مجهوداتهم في تحقيق التنمية المستدامة، وحتى يتم دراسة البحث على نحو شامل تعين إلقاء الضوء على العلاقة الأكبر وهي علاقة الملكية الفكرية بحقوق الإنسان باعتبارهما دائرتي حقوق تتقاطعا في مساحة أوسع من مساحة حق المؤلف وحقوق ذوي الإعاقة البصرية، حيث أن حق المؤلف يخرج من رحم الملكية الفكرية، كما أن حقوق ذوي الإعاقة البصرية تخرج من رحم حقوق الإنسان، ومن ثم فدراسة العلاقة بين حقوق الإنسان والملكية الفكرية، يعد بمثابة حجر الأساس الذي تقوم عليه دراسة إطار العلاقة بين حقوق ذوي الإعاقة البصرية وحقوق المؤلف، والمناهج التي بحثت إطار العلاقة لم تخرج عن منهجي التعايش ومنهج الصراع، وقليل من الباحثين على مستوي العالم قد اقترح منهج أخر مثل أوكيدجي، باقتراح منهج آخر وراء التعايش والصراع، وقد تم تناول تلك المناهج وتحليلها، للوصول إلى نتيجة هامة، تتمثل في أن الإطار لا يمكن أن يكون إطار صراع، وهو إطار أعمق من إطار التعايش أيضا، فهو إطار تكاملي، بحيث يتكامل حق المؤلف مع حقوق ذوي الإعاقة البصرية باعتبار أن كليهما ضمن طائفة حقوق الإنسان بمفهومها الأوسع، فضلا عن أن منهج التكامل هو المنهج الذي يتلاءم مع تحقيق أهداف التنمية المستدامة، وهو ما شملته الدراسة في مبحثين الأول هو طبيعة العلاقة بين الملكية الفكرية وحقوق الإنسان بصورة عامة، والثاني، طبيعة العلاقة بين حق المؤلف وحقوق الإنسان لذوي الإعاقة البصرية.

The relationship between the rights of people with visual disabilities and copyright, as the progress of nations is measured by the services they provide to people with disabilities in their societies, and the last decade has even been characterized by the presence of a new regulator to measure the new global concept called sustainable development, which is to measure the extent to which people with disabilities are integrated into their societies, and the extent The contribution they make themselves to the progress of their society, and thus the concern for the affairs of the visually impaired has two aspects that are not separate, but complement each other. to sustainable development. Considering that the relationship between rights intersects in circles that may sometimes lead to the implementation of rights at the expense of others, the present research is meant to challenge a framework for the nature of the relationship between the rights of people with visual disabilities and copyright, as the rights of the author may represent the major obstacle in the way of people with visual disabilities in Their way to obtain their rights, and therefore in order to integrate them into their societies, and to benefit from their efforts in achieving sustainable development, and until the research is studied in a comprehensive manner, it is necessary to shed light on the larger relationship, which is the relationship of intellectual property with human rights, as they are two rights circles that intersect in a broader area of copyright and rights People with visual disabilities, as copyright comes out of the womb of intellectual property, and the rights of people with visual disabilities emerge from the womb of human rights, and therefore studying the relationship between human rights and intellectual property is considered as the cornerstone on which the study of the framework of the relationship between the rights of people with disabilities is based. Visual and copyright, and the approaches that examined the framework of the relationship did not depart from the coexistence and conflict approaches, and a few researchers around the world have suggested another approach, such as Okiji, by suggesting a method Another is behind coexistence and conflict, and these approaches have been addressed and analyzed, to reach an important conclusion, which is that the framework cannot be a conflict framework, which is a deeper framework than the framework of coexistence as well. Both are within the range of human rights in its broadest sense, in addition to that the integration approach is the approach that is compatible with achieving the goals of sustainable development, which is what was included in the study in two sections. The first is the nature of the relationship between intellectual property and human rights in general, and the second, the nature of the relationship between copyright and human rights Person with visual impairment.
