المستخلص: The research paper revolves around the principle of “Devine Justice” according to the Mutazilite school of thought, and the role that this principle plays in establishing the doctrine by which to interact with legal texts. The researcher has included in this paper; an introduction, a preface, three discussions, and a conclusion. As for the introduction, it addresses: the importance of the research, the reason for selecting the topic, the critique of the researcher, his methodology in addressing the topic, the steps he took in presenting it, the previous studies addressing it, and the outline of the paper. The preface introduces the main concepts and ideas addressed by the paper. The first discussion addresses the principle of innate goodness and evil. The researcher mentions the linguistic as well as the technical definition of good and evil, and then goes on to discuss “action” as understood by the Mutazilites, and the rules that govern it. He then discusses the origin of the attributes of Allah that are related to action according to the Mutazilites, and their understanding of the basis of good and evil. The researcher then moves on to the matter of human action, and clarifies the position of the Mutazilites in regards to it. He concludes the discussion by explaining the effects of the rational understanding of good and evil on the division of “action”. The second discussion addresses the principle of divine kindness. The researcher mentions the linguistic as well as the technical definition of divine kindness, and mentions that divine kindness is divided into two categories according to the Mutazilites: “muhassil” kindness and “muqarrib” kindness. He concludes the discussion on this principle by mentioning the rules that govern divine kindness, and the proofs regarding it. The third discussion addresses the principle of “salah and aslah”. The researcher mentions the linguistic as well as the technical definition of this principle, and the rules that govern it according to the Mutazilites, he then concludes by mentioning the effect of this principle of the discussions in the field of Principles of Jurisprudence. In the conclusion, the researcher mentions his findings, and the most important results at which he arrived.

يدور البحث حول أهمية أصل (العدل الإلهي) عند المدرسة الاعتزالية، والدور الذي يقوم به هذا الأصل في إرساء القواعد المعالجة للنصوص الشرعية، وقد جعله الباحث مشتملا على: مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة. أما المقدمة فتناول فيها: أهمية البحث، وسبب اختيار موضوعه، وإشكالاته، ومنهجه، والخطوات التي سار عليها الباحث في عرض الموضوع، والدراسات السابقة له، وخطته. وأما التمهيد فتناول فيه: التعريف بأبرز سمات البحث وملامحه. وأما المبحث الأول فتناول فيه: قاعدة الحسن والقبح الذاتيين، فذكر تعريف الحسن والقبح لغة واصطلاحا، ثم تطرق منه إلى مفهوم الفعل عند المعتزلة وأحكامه، ثم تطرق منه إلى منشأ صفات الأفعال عند المعتزلة، ومنها إلى مدرك حسن الأفعال وقبحها عندهم، ثم إلى مسألة أفعال العباد، فبين المراد من أفعال العباد من منظور المدرسة الاعتزالية، ثم ختم المبحث ببيان أثر قاعدة الحسن والقبح العقليين في تقسيم الأفعال. وأما المبحث الثاني فتناول فيه: قاعدة اللطف الإلهي، فذكر تعريف اللطف الإلهي لغة واصطلاحا، وذكر أن للطف الإلهي عند المعتزلة قسمين، هما: اللطف المحصل، واللطف المقرب، ثم ختم الكلام عن هذه القاعدة بذكر حكم اللطف الإلهي عند المعتزلة، ودليله. وأما المبحث الثالث فتناول فيه: قاعدة الصلاح والأصلح، فذكر تعريف الصلاح والأصلح لغة واصطلاحا، وذكر حكم قاعدة الصلاح والأصلح عند المعتزلة، ثم ختم الكلام عن هذه القاعدة ببيان أثرها في مباحث أصول الفقه. وأما الخاتمة فذكر فيها أهم ما توصل إليه من نتائج، وتوصيات.
