المستخلص: يهدف هذا البحث إلى بيان موقف الشريعة الإسلامية من تأثير العوامل الوراثية في اختيار المكلف وإرادته، مع بيان اتجاهات العلماء في فهم النصوص التي قد يفهم منها تأثير الجين الوراثي في اختيار المكلف، وتحليلها، وصولا إلى معرفة هل الجين الوراثي معدم لإرادة المكلف، أو لا؟ معتمدا على أهم القواعد الأصولية التي يمكن الاستناد إليها في هذا الصدد، وأثرها في ترجيح أي من الاتجاهين على الآخر، مع التعرض لأهم التدابير الشرعية للوقاية من تأثير الجينات والأمراض الوراثية في جوانب تأثيرها. وقد اعتمدت فيه على المنهجين التاليين: - المنهج الاستقرائي: وذلك من خلال جمع وانتقاء النصوص ذات العلاقة بالموضوع، والاستعانة بها في تحديد معالم البحث. - المنهج التحليلي: وذلك بفحص تلك النصوص وتعليلاتها بعد جمعها، وبيان العلاقات وتحليلها. وقد ظهر في النتائج: مدى اهتمام الشريعة الإسلامية بالصفات الوراثية، كما تبين أن لها فضل السبق على علم الوراثة الحديث، وأن اهتمامها نابع من اهتمامها البالغ بمقصد المحافظة على النسل، وأن الشريعة الإسلامية، والملل السماوية السابقة عليها تتفق على عدم تأثير الجينات الوراثية في فعل المكلف وإرادته، كل ذلك في ضوء القواعد الأصولية التي بين جنبات هذا البحث. وقد خلص البحث - أيضا - إلى بعض التوصيات للباحثين بمحاولة الخروج بعلم أصول الفقه من النظرية إلى محاولة التطبيق، والتحليل، لفتح مجالات جديدة للبحث العلمي. والله الموفق.

The purpose of this research is to clarify the Sharia (Islamic law) position statement on the impact of the genetic factors on the choice the legally competent make and their will, and to state the approaches of scholars in respect of understanding and analyzing the texts the interpretation of which could include that the gene has an impact on the choice the legally competent make; to understand whether the gene nullifies the will of the legally competent or not. This is based on the principles of the Islamic jurisprudence that could be used in this regard, and their effect on one of the two directions outweighing the other, with discussion of the most important Sharia-related preventive measures against the impact of genes and genetic diseases on the aspects they affect. In this research I adopted the following two approaches: -The Inductive Approach: Through collection and selection of the texts related to the topic, and using them in drawing the outline of the research. -The Analytical Approach: Through securitization of these texts and their explanations after they are collected and demonstration and analysis of relationships. The results showed that the Sharia (Islamic law) paid great attention to the genetic traits; that it preceded the modern genetics; that its serious attention was in order to preserve the descendants; that the Islamic law and the heavenly religions before it agreed that the genes had no impact on the action or the will of the legally competent. This all is in light of the principles of the Islamic jurisprudence stated across this research. The research also includes recommending the attempt of taking the principles of the Islamic jurisprudence from theory to practice and analysis to researchers in order to open new fields for scientific research.
