المستخلص: لقد اعتنى علماء الأصول ببيان المواصفات التي ينبغي على المجتهد تحصيلها، وحرروا القواعد التي يطلب منه الاستناد إليها في استنباط الأحكام. وفصلوا الكلام في كثير من هذه القواعد، وأجملوا الكلام في البعض الآخر. ومن قبيل هذا الأخير دور معرفة الواقع الذي كان يعيشه النبي "صلى الله عليه وسلم" وصحابته الكرام في فهم نصوص الوحي وتوجيهها التوجيه السليم. فجاء هذا البحث لإلقاء الضوء على هذه القضية الهامة، وتناولت من خلاله أثر عادات من نزل فـيهم القرآن في فهم نصوصه، وكيفية التعامل معها فهما واستنباطا. وبينت الدور البارز لمعرفة الواقع الذي نزلت فيه بعض الأحكام في تغيير هذه الأحكام. ولما كان لهذا الموضوع علاقة بشبهة تاريخية النصوص التي يدعي أصحابها لزوم إخضاع النص الـديني للواقع الذي نزل فيه، مما يقودنا إلى إسقاط كثير من الأحكام بوصفها أحكاما تاريخية، رأيت أن أتناول هذه الشبهة بشيء من الإيجاز، مقتصرا على المداخل الوهمية لهذه الفكرة، والمستندات الدينية التي بنيت عليها، للتأكد من عدم موافقتها لهذه المستندات.

The ability of the Development of Islamic Jurisprudence is considered to be the highest purpose sought by the seekers in the path of ijtihad, and the scholars of the assets have taken care to indicate the specifications that the Mojtahid should collect, while editing the rules on which he must base the process of inference. They clarified the speech in many of these rules, and they made it very summarized in others. The latter has the role of knowing the reality of the Prophet and his esteemed companions in understanding and properly directing the texts of revelation. The linguistic aspect of knowledge of semantics has been focused on by the scholars of the assets in understanding the texts of revelation. They had little regard for knowing the circumstances of life in which these texts were contained in order to draw judgments According to them. It is true that contemporary scholars took care of the importance of the jurisprudence of reality to the mujtahid people, but their research was focused on the role of the living jurisprudence in the Implementation of judgments, not the role of knowing the reality of the Prophet's era in the development of judgments. There is a vast difference between the two subjects. This research came to highlight this issue and study it from the root and practical side. The second objective of the research will be to examine the claims of some contemporary modernists that all the provisions of the Qur'an were in response to a certain reality and therefore valid for that era with its historical circumstances, as with historical development, those provisions are no longer valid for this time.
