المستخلص: عنوان البحث: معالم منهج البحث الفقهي والعلمي عند الإمام الشافعي من خلال كتابه "الأم" استقراء وتطبيق من كتاب "الجهاد والجزية" إلى كتاب "النكاح". موضوع البحث: جمع معالم منهج البحث الفقهي والعلمي عند الإمام الشافعي- رحمه الله- في كتابه "الأم" من كتاب "الجهاد والجزية" إلى كتاب "النكاح"، ثم بيان المعالم من خلال: أ. شرح المعلم المستنبط مع توضيح معناه. ب. ذكر الشواهد على ذلك المعلم المستنبط. وقد جاء البحث مكون من مقدمة وأربعة مباحث وخاتمة. أما المقدمة: فقد اشتملت على بيان أهمية الموضوع، وسبب الاختيار، ومنهج البحث وخطته والصعوبات التي اعترضت الباحثة- إن وجدت-. أما المباحث فكانت كالآتي: المبحث الأول: التعريف بالإمام الشافعي وكتابه "الأم" ومعالم منهجه العامة المذكورة في مقدمة كتاب الرسالة، وفيه ثلاثة مطالب: أولها: التعريف بالإمام الشافعي. ثانيها: التعريف بكتاب الأم. ثالثها: معالم منهج الإمام الشافعي العامة المذكورة في مقدمة كتاب الرسالة. المبحث الثاني: المعالم الخاصة بمنهج البحث الفقهي عند الإمام الشافعي وفيه مطلب واحد وستة عشر معلما. المبحث الثالث: المعالم الخاصة بالعلوم التي أتقنها الإمام الشافعي وبرع فيها غير الفقه والأصول وفيه أربعة مطالب. المبحث الرابع: المعالم الخاصة بأدبيات البحث العلمي عند الإمام الشافعي وفيه اثنا عشر معلما. ثم الخاتمة: تضمنت أهم نتائج البحث وبعض التوصيات والمقترحات ومن أهم النتائج: 1- أهمية مناهج البحث الفقهي والعلمي عند الفقهاء ودورها في إثراء الفقه الإسلامي من خلال استخراج المعالم على تلك المناهج وربطها بها. 2- أهمية كتاب الأم في المذهب الشافعي، حيث كان له التأثير الأكبر في اعتماد الأئمة واستمدادهم منه. 3- شخصية الإمام الشافعي رحمه الله والتي كان الأثر الواضح في تاريخ الفقه الإسلامي.

Research title: Features of the jurisprudential and scientific research method of Imam Al-Shafi’i through his book “Al-Umm” extrapolation and application from the book “Jihad and tribute” to the book. The Nikah Research topic: A collection of the features of the jurisprudential and scientific research method of Imam Al- Shafi’i- may God have mercy on him- in his book “The Mother” from the book “Jihad and Tax” to the book ”Marriage,” then explaining the features through: a. Explanation of the deduced teacher with clarification of its meaning. NS. He mentioned the evidence for that deduced teacher. The research consisted of an introduction, four chapters, and a conclusion. As for the introduction: it included a statement of the importance of the topic, the reason for selection, the research method and plan, and the difficulties that the researcher encountered- if any -. The investigations were as follows: The first topic: introducing Imam Al-Shafi’i and his book “Al-Umm” and the general features of his approach mentioned in the introduction to the book, and it contains three demands: The first is the introduction of Imam al-Shafi’i. Second: Introducing the Mother's Book. The third: the general features of Imam Al-Shafi’i’s approach mentioned in the introduction to the book “The Message”. The second topic: the features of the jurisprudential research method of Imam Al-Shafi’i, and it contains one requirement and sixteen teachers. The third topic: the special features of the sciences that Imam Al-Shafi’i mastered and excelled in other than jurisprudence and principles, and there are four demands. The fourth topic: features of the literature of scientific research according to Imam Al-Shafi’i, and it has twelve teachers. Then the conclusion: It included the most important results of the research and some recommendations and suggestions. The most important results are: 1- The importance of jurisprudence and scientific research methods for jurists and their role in enriching Islamic jurisprudence by extracting features on those curricula And link it to it. 2- The importance of the book Al-Umm in the Shafi’I school of thought, as it had the greatest influence in adopting the imams and drawing them from it. 3- The personality of Imam Al-Shafi’i, may God have mercy on him, which was the clear impact in the history of Islamic jurisprudence.
