|a ركزت هاته الدراسة على بحث طبيعة العلاقة بين المواطن والإدارة في الجزائر وذلك من وجهة نظر قانونية، أساسها إرادة تشريعية رسمت حدود تلك العلاقة وبينت مرتكزاتها الجوهرية، على ضوء المرسوم رقم 88/ 131، هذا الأخير الذي اتسمت أحكامه بالمحدودية إذا ما تم مقاربتها مع الواقع العملي، كما حاولت هاته الدراسة مقاربة تلك العلاقة القانونية مع ما أصبح يعرف بضابط العصرنة الإلكترونية، والذي جسدته تجربة تشريعية مغربية، أبانت على أسس متينة لاعتماده في إطار العلاقة بين المواطن والإدارة المغربية، لتعتبر بحق نموذجا يمكن الاقتداء به، من خلال القيام بمراجعة شاملة لأحكام المرسوم رقم 8/ 131، بتوظيف البعد الإلكتروني كناظم أساسي للعلاقة بين المواطن والإدارة، مع توفير الإطار التنظيمي المناسب.

|b This study focused on researching the nature of the relationship between citizen and administration in Algeria from a legal point of view, it is based on a legislative will which has defined its limits and clarified its fundamental axes, according to decree no. 88/131, the latter, whose provisions were characterized by limitations if they were approached with practical reality, this study also attempted to approach this legal relationship with what has become known the electronic modernization standard, this was embodied by moroccan legislative experience, the latter it revealed solid bases for its adoption in the framework of relations between the citizen and the moroccan administration, it really is a model it can be emulated ,through to make complete modifications to the provisions of decree no. 88/131, by using the electronic dimension as a regulator of relation between the citizen and the administration whith the appropriate regulatory framework.
