المستخلص: إن التقدم في العلوم الطبية والتقنية قد حول الجمال إلى صناعة. وقد أسهمت وسائل الإعلام والتواصل الاجتماعي بشكل فعال ومباشر في شيوع ثقافة التجميل، حتى صار التجميل سمة العصر وعنوانا للتمدن، فعرفت به عواصم، وخصصت له القنوات، ووضعت له مباريات ومقاييس خاصة، ودخل قطاع الأعمال، لتتوارى خلفه الأخلاق والطباع والفكر. إن هذه الدراسة الموسومة "التنظيم القانوني لجراحة التجميل التحسينية" تنطلق من الحاجة الماسة لوجود قواعد قانونية خاصة بجراحة التجميل التحسينية بسبب الفوضى التي تشهدها، وغلبة الطابع التجاري على ممارستها، وإخضاعها لأحكام الجراحة العلاجية، بالرغم من الاختلاف الجوهري بينهما. فثمة فارق رئيس بين الجراحة التي تتم على عضو مريض بقصد علاجه، وبين الجراحة التي تجرى لعضو معافى بقصد تحسين مظهره. علاوة على الخلط بين ما هو جائز من هذه الجراحات وبين ما هو غير مشروع منها. ولهذا كان من الطبيعي أن تتناول هذه الدراسة ماهية هذه الجراحة وموقف القوانين الأجنبية والعربية منها. ثم البحث في واقع هذه الجراحة في المملكة العربية السعودية، لجهة الرأي الشرعي في مشروعيتها، والضوابط التي تحكم إجراءها، والقواعد الحاكمة لها.

The rapid rate of recent technological and medical advancement helped transform beauty into a huge industry. Furthermore, media and social media have effectively and directly contributed to the spread of beauty culture. For most people, beauty became a key feature in this era and closely linked to modernization; which resulted in the emergence of international destinations of choice for cosmetic surgery and cosmetic surgery channels. In the last few decades, beauty competitions were held and modern beauty standards were set. As a result, cosmetic surgeries became part of the business sector, while other human aspects – such as morals, manners and thought - retreated to become second in place after beauty, due to its great importance currently. This study, which is titled “Legal Regulation of Cosmetic Plastic Surgeries”, stems from the urgent need to draft legal rules for cosmetic plastic surgeries to end the current chaos this sector witnesses, the predominance of the commercial nature on its practice, and its subjection to the regulations of therapeutic surgeries - despite the fundamental difference between them. There is a major difference between surgery performed on a sick organ with the intent to treat it, and surgery performed on a healthy organ with the intention of improving its appearance. In addition, there is impulsive confusion between permissible cosmetic surgeries and illegal cosmetic surgeries. Therefore, this study aimed at examining the nature of cosmetic surgeries and foreign and Arab laws’ position on them. Moreover, the study highlighted the reality of cosmetic surgeries in the Kingdom of Saudi Arabia, in terms of Islamic Shariah’s opinion of their legitimacy, the controls of performing cosmetic surgeries, and the rules governing them.
