المستخلص: يهدف هذا البحث لدراسة الاشتراط في عقد النكاح وأثره، وهو موضوع يتعلق بالأسرة التي هي أساس المجتمع، فبينت فيه تعريف الاشتراط والفرق بينه وبين الشرط، وأنواع الاشتراط، ومدى جواز الاشتراط في عقد النكاح، والاشتراط في عقد النكاح: إما أن يكون موافقا لمقتضى عقد النكاح، كشرط الزوجة على الزوج العشرة بالمعروف والإنفاق والكسوة والسكنى، وشرطه عليها أن لا تخرج إلا بإذنه، ولا تمنعه نفسها، ولا تصوم تطوعا بغير إذنه، ولا تأذن في بيته إلا بإذنه، أو منافياً لمقتضى عقد النكاح، كشرط الزوج على المرأة أن لا ينفق عليها، أو لا يكسوها، أو لا يعطيها ولدها، أو أن لا إرث بينهما، أو خارجاً عن معنى عقد النكاح، كشرط الزوجة على زوجها أن لا يتزوج عليها، أو أن لا يخرجها من بلدها، أو من بيتها، أو منهيا عنه شرعا في عقد النكاح، كتأقيت النكاح، وتعليقه.

This research aims to study the stipulation in the marriage contract and its impact. It is a topic related to the family, which is the foundation of society. I explained in it the definition of a stipulation and the difference between it and a condition, the types of stipulation, and the extent to which it is permissible to stipulate a condition in a marriage contract. And the stipulation in the marriage contract: either it is in accordance with the requirements of the marriage contract, such as the condition of the wife on the husband to maintain good relations, spending, clothing and housing, and his condition is that she does not go out without his permission, and does not prevent herself, and does not fast voluntarily without his permission, and does not permit in his house without his permission, or contrary to the requirements of the marriage contract, such as the husband’s condition on the woman that he not spend on her, or not clothe her, or not give her child, or that there is no inheritance between them, or outside the meaning of the marriage contract, such as the wife’s condition on her husband that he not marry another woman over her, or that he should not expel her from her country or her home, or forbidden by Sharia in the marriage contract, such as specifying the duration of the marriage, and suspension of marriage.
