المستخلص: تهدف هذه الدراسة إلى تسليط الضوء على حكم اشتراط المسجد الحرام للطواف. وقام الباحث بذكر أقوال العلماء في ذلك، ومناقشتها في عدة مباحث. وأشارت النتائج إلى أنه يجوز الطواف خارج المسجد، إذ لا يوجد دليل صريح على اشتراط المسجد للطواف، لا سيما في وقت الضرورة والضيق. وأنه على فرض شرطيته فإنه يتسامح في هذا الشرط عند الضرورة كما تسامح الفقهاء في كثير من شروط الصلاة في حال الضرورة. إذ فرق الفقهاء في الأحكام بين حال السعة والاختيار، وبين حال الضيق والشدة والحاجة والضرورة. وأوصت الدراسة بالاهتمام بمثل هذه المسائل التي يحتاج إليها الناس في هذه الأيام، لا سيما مع شدة الزحام، والأمور العظام التي قد تحدث كالوباء وغيره. وأوصت كذلك بوجوب مراعاة أحوال الناس المختلفة من السعة والضيق وغير ذلك عند الفتوى أو الحكم على الأفعال.

This study aims to shed light on the ruling on the Sacred Mosque's requirement for Tawaf. The researcher mentioned the sayings of the scholars on that, and discussed them in several investigations. The results indicated that it is permissible to perform Tawaf outside the mosque, as there is no clear evidence that the circumambulation requires the mosque, especially in times of necessity and distress. And that, on the supposition of its requirement, the condition is tolerated when necessary. This is exactly the same when the jurists tolerated many conditions required for prayer in case of necessity. In fact, the jurists distinguished in rulings between a state of capacity and choice, and between a state of distress, severity, need and necessity. The study recommended paying attention to such issues that people need these days, especially with the intensity of crowds, and the great matters that may occur such as the epidemic and others. The study also recommended that the different conditions of people should be taken into account, such as capacity, distress, and so on, when issuing fatwa or judgment on people actions.
