يقترب دستور عام 1996 بالدساتير المعتمدة في الأنظمة الديمقراطية الليبرالية، فيما يتعلق حماية الحقوق والحريات العامة بما في ذلك تلك المتعلقة بالمرأة. إذا كان من البديهي أن تمارس حرية أو حق ما في إطار القيود والحدود التي رسمتها تلك الدساتير، إلا أن بعض القيود التي جاء بها المؤسس الجزائري، المتمثلة في مبادئ الإسلام وقيم ثورة نوفمبر، تبدو صعبة التوفيق مع القيود الضرورية في مجتمع ديمقراطي. La constitution de 1996 se rapproche des constitutions adoptées par les démocraties libérales en matière de protection des droits et libertés publiques notamment ceux consacrés à la femme. S’il parait évident qu’une liberté ou un droit ne s’exerce que dans le cadre des limites et restrictions édictées par lesdites constitutions, il s’avère cependant que certaines des restrictions prévues par le constituant algérien, que sont la morale islamique et les valeurs de la révolution de novembre, difficiles à concilier avec les restrictions nécessaires dans une société démocratique. The 1996 Constitution approaches constitutions adopted in liberal democratic systems regarding the protection of public rights and freedoms, including those relating to women. It was obvious that some freedom or right should be exercised within the framework of the restrictions and limits set by those constitutions; however, some of the restrictions made by the Algerian founder, namely the principles of Islam and the values of the November Revolution, seem difficult to reconcile with the necessary restrictions in a democratic society.
