Le législateur algérien a consacré, conformément à l’ordonnance n°08- 04 fixant les conditions et modalités de concession des terrains relevant du domaine privé de l’état destinés à la réalisation des projets d’investissement, le contrat de concession en tant que mécanisme d’exploitation du foncier industriel. Cette recherche aborde, d’une part, les conditions et les modalités d’octroi du contrat de concession. D’autre part, l’étude tente de clarifier les implications et les conflits provenant de la mise en oeuvre du contrat de concession.

The Algerian legislator, by virtue of Ordinance No. 08-04, which specifies the conditions and modalities for granting concessions on lands belonging to the private properties of the state and destined for the implementation of investment projects, established the concession contract as a mechanism for exploiting real estate directed to industrial investment. Therefore, the terms and conditions for concluding the concession contract will be addressed, as well as the implications of implementing the concession contract and the disputes arising from it.
