المستخلص: يعتبر عنصر الاستقلالية أهم العناصر المميزة لسلطة ضبط السمعي البصري، ويعود ذلك لكون هذه الاستقلالية هي التي تميزها عن السلطات العادية أو التقليدية للدولة، وتقاس درج استقلالية سلطة ضبط السمعي البصري من ناحيتين، العضوية والوظيفية. فمن الناحية العضوية ينبغي التعرض إلى تعدد الأعضاء واختلاف مراكزهم، ووجود نظام التنافي، والتمتع بالشخصية المعنوية، أما من الناحية الوظيفية فتقاس درجة استقلالية سلطة ضبط السمعي البصري بمدى تمتعها بالاستقلال الإداري والمالي ووضعها للنظام الداخلي.

L’indépendance est un volet essentiel qui caractérise l’autorité de régulation de l’audiovisuelle, puisqu’il est au coeur même de l’originalité de cette autorité dans l’appareil administratif de l’Etat. Les critères déterminants pour mesurer le degré de L’indépendance de l’autorité de régulation de l’audiovisuelle, dans son double aspect organique et fonctionnel, sont d’une part, la pluralité des membres et la diversification de leur statut, le régime des incompatibilités, et l’octroi de la personnalité juridique. D’autre part, l’indépendance l’autorité de régulation de l’audiovisuelle au plan fonctionnel, sont mesuré par une autonomie administrative et financière et le règlement intérieur.

The element of independence is considered the most important characteristic of the audiovisual control authority, due to the fact that this independence is what distinguishes it from the ordinary or traditional authorities of the state. The degree of independence of the audiovisual control authority is measured in terms of membership and functionality. In terms of membership, it should be exposed to the multiplicity of members and their different positions, the existence of a system of incompatibility, and the enjoyment of a legal personality. As for the functional aspect, the degree of independence of the audiovisual control authority is measured by the extent to which it enjoys administrative and financial independence and its status in the internal system.
