المستخلص: يهدف البحث إلى بيان مشروعية التجديد في الفكر الإسلامي من خلال نصوص الوحيين، وفعل الصحابة والتابعين، وعلماء الأمة المعتبرين منذ العصور الأولى حتى يومنا هذا؛ كما يبين أن التجديد في الفكر الإسلامي له دوافع محمودة شرعا، ومقبولة عقلا وواقعا، كما يؤكد البحث أن التجديد في الفكر الإسلامي عملية لا يمكن لآحاد العلماء خوضها؛ لأنها تحتاج إلى علماء معتبرين، قد بلغوا ذروة السنام في الاجتهاد في النوازل والمستجدات التي لم تكن على عهد من سبقوهم من العلماء؛ ولذا كان لابد من توافر عدة ضوابط في عملية التجديد في الفكر الإسلامي؛ فضلا عن توافر عدة شروط في المجدد نفسه. واستخدمت في هذه الدراسة المنهج الاستقرائي: عند تتبعي لجل ما يدعم عملية التجديد في الفكر الإسلامي، ويرغب في إجرائها؛ من نصوص الوحيين الشريفين، وتطبيق الصحابة والتابعين، ومن اقتفي أثرهم من فقهاء الأمة المجتهدين. كما استخدمت المنهج التحليلي: في تحليل الآيات القرآنية، والأحاديث النبوية التي تثبت مشروعية التجديد في الفكر الإسلامي، وتحليل ما قام به الصحابة والتابعون وعلماء الأمة في هذا المضمار؛ ثم قمت بتحليل دوافع التجديد، وبيان ما يلزم لهذه العملية من ضوابط وشروط. كما استخدمت المنهج التقويمي: في تقييم آراء العلماء في التجديد من جميع الجوانب والزوايا، والثناء على ما جاء منها موافقا لمراد القرآن الكريم والسنة المطهرة، ورد ما يخالف ذلك. وتوصلت من خلال هذه الدراسة إلى: 1-أن التجديد في الفكر الإسلامي من الأمور المشروعة التي حثت عليها نصوص القرآن الكريم، وصحيح السنة النبوية، وفعل الصحابة والتابعين، والعلماء المعتبرين 2-أن التجديد في الفكر الإسلامي ضرورة حتمية لا يمكن تجاهلها أو التغافل عنها 3-أن التجديد في الفكر الإسلامي لا يعني الانسلاخ من ثوابت الإسلام ومبادئه-وقيمه؛ بل يعني العودة به إلى المنبع الصافي الذي تركنا عليه نبينا صلى الله عليه وسلم. 4-أن التجديد في الفكر الإسلامي له ضوابط يجب أن ينطلق علماء التجديد من خلالها؛ حتى يصلوا إلى النتائج المنشودة من هذ العملية المهمة 5-أنه لا يحق لأي باحث في العلوم الشرعية الخوض في التجديد في الفكر الإسلامي؛ لأن هذا باب لا يجيده آحاد العلماء. التوصيات والمقترحات: أوصي بإنشاء هيئة علمية في كل قطر من أقطار المسلمين تعمل على تنقية كتب التراث مما علق بها من الإسرائيليات والأساطير التي يرفضها الإسلام. أوصي باستحداث مواد دستورية تجزم خوض غير المتخصصين في علوم الشريعة الإسلامية. أوصي علماء المجامع الفقهية بمتابعة النوازل والمستجدات ودراستها من سائر جوانبها؛ ووصمها عن الحكم الشرعي المناسب لها؛ حتى يغلقوا باب الاجتهاد في هذه النوازل آحاد العلماء؛ فضلا عن غير المتخصصين.

The research aims to clarify the legitimacy of renewal in Islamic thought through the texts of the two revelations, the actions of the companions and followers, and the respected scholars of the nation since the early ages until the present day; It also shows that renewal in Islamic thought has legitimate motives that are acceptable in reason and reality. The research also confirms that renewal in Islamic thought is a process that no single scholars can engage in; Because it needs respected scholars, who have reached the height of the hump in diligence in calamities and developments that were not in the era of those who preceded them from among the scholars; Therefore, it was necessary to have several controls in the process of renewal in Islamic thought. In addition to the availability of several conditions in the renewal itself. In this study, I used the inductive approach: when I followed everything that supports the process of renewal in Islamic thought and desires to conduct it; From the texts of the two noble revelations, the application of the companions and followers, and those who traced their trail from the diligent jurists of the nation. It also used the analytical method: in analyzing the Qur’anic verses and the Prophetic hadiths that prove the legitimacy of renewal in Islamic thought, and analyzing what the Companions, followers and scholars of the nation did in this regard; Then I analyzed the motives for renewal, and stated the necessary controls and conditions for this process. It also used the evaluative approach: in evaluating the views of scholars on renewal from all sides and angles, and praising what came from it in accordance with the intent of the Noble Qur’an and the purified Sunnah, and what is contrary to that. Through this study, I found: 1- Renewal in Islamic thought is one of the legitimate matters urged by the texts of the Noble Qur’an, the authentic Sunnah of the Prophet, the actions of the Companions and their followers, and respected scholars. 2- Renewal in Islamic thought is an inevitable necessity that cannot be ignored or ignored. 3- Renewal in Islamic thought does not mean alienation from the constants, principles and values of Islam; Rather, it means returning it to the pure source on which our Prophet- may God bless him and grant him peace- left us. 4- Renewal in Islamic thought has controls that scholars of renewal must proceed through; In order to reach the desired results from this important process. 5- that no researcher in Islamic sciences has the right to engage in renewal in Islamic thought; Because this section is not good at the individual scholars. Recommendations and suggestions: 1- I recommend the establishment of a scientific body in every Muslim country that works on purifying heritage books from the Israelites and myths that Islam rejects. 2- He recommended the creation of constitutional articles that criminalize the practice of non-specialists in the sciences of Islamic law. 3- I recommend the scholars of the Fiqh academies to follow up on calamities and developments and study them from all their aspects; and stigmatized it by the appropriate legal ruling; Until they close the door of ijtihad in these calamities, individual scholars; As well as non-specialists.
