المستخلص: أحاط المشرع المغربي حريات التجمع بجملة من المقتضيات القانونية والتنظيمية التي حددت شروط وكيفيات ممارسة الاجتماعات والتجمهر والتظاهر السلمي من قبل الأشخاص أفرادا أو جماعات من داخل أو خارج المنظمات المؤسسة بصفة قانونية كالجمعيات والنقابات والأحزاب السياسية. ويعد القانون رقم 76.00 حجر الزاوية في تأطير حريات التجمع كما جاء بها الفصل 29 من دستور المملكة المغربية لسنة 2011 بما يحتويه من شروط وكيفيات تسمح بضبط التجمعات من قبل السلطات الإدارية المحلية، وبما يخوله أيضا لأصحاب الحريات من ضمانات التنزيل السليم لتلك الحريات الأساسية، وفي مقدمتها ضمانات الحماية التشريعية والقضائية. يعالج هذا المقال إشكالية الطبيعة القانونية والتنظيمية والتدبيرية التي تحيط بشروط وكيفيات ممارسة أصحاب الحقوق الحريات التجمع وضمانات حمايته التشريعية والقضائية الكفيلة بتنزيلها بشكل سليم على أرض الواقع توسيعا وتضييقا، بما يتيحه من تحقيق الملاءمة بين إطلاقيه ممارسة حريات التجمع تلك وحدود السلطة التقديرية المخولة للسلطات الإدارية المحلية في اتجاه المنع أو التضييق على ممارسة تلك الحريات وتقييدها خارج نطاق تطبيقات حالة الطوارئ الصحية.

Freedoms of assembly in Chapter 29 of the 2011 Constitution between terms of practice and proper implementation guarantees. Morocco's legislator surrounded the freedoms of assembly with a set of legal and regulatory requirements that specified the conditions and modalities for the exercise of meetings, gatherings and peaceful demonstrations by individuals or groups from within or outside legally established organizations, such as associations, trade unions and political parties. Law No. 76.00 is the cornerstone in framing the freedoms of assembly as stated in Chapter 29 of the Constitution of the Kingdom of Morocco for the year 2011, including the conditions and modalities for controlling assemblies by the local administrative authorities, and also granting freedom holders guarantees of proper implementation of those fundamental freedoms, primarily legislative and judicial protection guarantees. This article addresses the problem of the legal, regulatory and administrative nature that surrounds the conditions and modalities for rights holders to exercise the freedoms of assembly and the guarantees that they are properly implemented on the ground, thereby broadening and restricting the exercise of such freedoms, the thing that allows achieving compatibility between the absolute exercise of these freedoms of assembly and the limits of the discretion granted to local administrative authorities towards the prevention or restriction of such freedoms Outside the scope of health emergency applications .
