المستخلص: إن الكلام عن صلة المقاصد الشرعية بالأصول الأصلية والتبعية أمر استدعته ضرورة تسليم عملية الاجتهاد من المطبات والهنات، لأن كل اجتهاد أزاح المقاصد ولم يعتبرها إلا وطاله الفساد وجانبه الصواب. والفقيه والأصولي في حاجة لمقاصد الشريعة تنظيرا وتطبيقا. وما تسعى إليه هذه الورقة هو توضيح وكشف مدى مقاصدية الأصول التبعية، ليسلم الاجتهاد عموما والاجتهاد المقاصدي خصوصا من جرأة بعض المتحاملين عليه، وأيضا ليدرك الفقيه المجتهد حاجته لمقاصد الشريعة وضرورة استصحابه لها في القضايا والنوازل، كما سعت هذه الورقة البحثية إلى إبراز العلاقة بين مقاصد الشريعة وأصول الفقه، وهل المقاصد فعلا من صميم الأصول ولا يمكنها أن تحيد عنه؟ أم أنها علم مستقل بذاته؟

Talking about the connection of legal purposes with the original principles and subordination is a matter called for by the necessity of freeing the process of diligence from bumps and pitfalls, because every diligence (AL_IJTIHAD) removed the objectives and did not consider them except that corruption and its right side became corrupt. The jurist and the fundamentalist are in need of the purposes of Sharia in theory and application What this paper seeks is to clarify and reveal the extent of the objectives of the dependent assets, so that diligence in general and intentional diligence in particular escape from the audacity of some of those prejudiced against it, and also for the diligent jurist to realize his need for the purposes of Sharia and the need to accompany it in cases and calamities, as this research paper sought to highlight the relationship between the purposes of Sharia. And the principles of jurisprudence, and are the purposes really from the core of the principles and cannot deviate from it? Or is it an independent science?
