At the international level, If there is no dispute on the obligation of States to protect and promote the civil and political rights, then the nature of the states' obligation will be less clear in protecting the social and the economical rights including the social security as a social right. Whereas, at the national level, the right of social security in Iraq is organized under the social care Act No. 126 of 1980 amended under the social protection Act No. (11) of 2014. Wherefore the study has two approaches. The first approach is dealing with the ratification of the social security right and nature of states' commitment to its fulfillment. While the second one is dealing with analyzing the most important provisions of the social protection Act No. (11) of 2014. The researcher comes up with many important results one of which is that the states have to ensure, at least, providing the main levels of social security for the most deprived people as a starting point in the way of providing a gradual comprehensive usufruct for the social security system. He, the researcher, also concludes that there is a legislative deficiency in most of the provisions of the second article of the social protection Act No. (11) of 2014, so it is necessary to be reviewed and amended. |
