|a هدفت هذه الدراسة إلى تعرف دور لجنة المصالحة المجتمعية الفلسطينية بوصفها نموذجا للعدالة الانتقالية في تحقيق المصالحة الوطنية، وسعت لتحقيق هذا الهدف من خلال ثلاثة محاور؛ الأول: يتعلق بمعوقات لجنة المصالحة المجتمعية، والثاني بآليات لجنة المصالحة المجتمعية، والثالث بمعززات لجنة المصالحة المجتمعية، واستخدم الباحث المنهج الوصفي التحليلي من خلال وصف الظاهرة موضوع الدراسة، إلى جانب إجراء دراسة ميدانية للتعرف إلى دور لجنة المصالحة المجتمعية في تحقيق المصالحة الوطنية، وذلك من خلال تصميم استبانة تعكس استجابات القانونيين والسياسيين في الضفة الغربية وقطاع غزة. وتوصلت الدراسة إلى مجموعة من الاستنتاجات أهمها: أن المعوقات التي تواجه لجنة المصالحة المجتمعية أكبر من الآليات أو المعززات التي تحفزها لأداء مهامها، كما أظهرت الدراسة أن أبرز المعوقات تكمن في غياب الإرادة السياسية ومحدوديتها، وقلة الإمكانيات المادية المخصصة لعمل اللجنة، ويعد تعويض الضحايا وضمان عدم تكرار الانتهاكات أبرز آليات لجنة المصالحة المجتمعية، بينما يعد اختيار أعضاء لجنة المصالحة المجتمعية على وفق اعتبارات الكفاءة والقبول المجتمعي - أبرز المعززات. وقد خرجت الدراسة بمجموعة من التوصيات أبرزها: ضرورة توفير مخصصات مالية من موازنة الحكومة الفلسطينية لملف لجنة المصالحة المجتمعية وتعويض الضحايا، وضرورة إعادة تشكيل أعضاء لجنة المصالحة المجتمعية على وفق اعتبارات الكفاءة والقبول المجتمعي وليس لاعتبارات فصائلية، كما أوصت الدراسة بضرورة وقف خطابات الكراهية والتحريض الإعلامي.
|b The aim of this study was identifying the role of the Palestinian Community Reconciliation Committee as a model for transitional justice in achieving the national reconciliation. This study focused on achieving this goal through three axes: the obstacles encountering the Community Reconciliation Committee, the mechanisms of the Community Reconciliation Committee and support and enhancements of the Community Reconciliation Committee. The researcher used the analytical descriptive approach describing the phenomenon of the study in addition to conducting a field study to identify the role of the Community Reconciliation Committee in achieving the national reconciliation by designing a questionnaire and taking the responses of the lawyers and politicians in the West Bank and Gaza Strip. The study concluded that the obstacles faced by the Community Reconciliation Committee were greater than the mechanisms or incentives that motivated them to carry out their tasks. The obstacles were represented by the lack of the political will and limited financial resources. The study also concluded that the compensation of victims and ensuring that violations are not repeated should be the basic mechanisms of the work of Community Reconciliation Committee. In addition, the selection of members of the Community Reconciliation Committee, which is based on the considerations of efficiency and community acceptance, should be regarded as one of the prominent enhancements. The study concluded a set of recommendations, the most important of which is the need to provide financial allocations by the Palestinian government budget for the file of the Community Reconciliation Committee, compensation of victims and the need to restructure the members of the Community Reconciliation Committee on the considerations of competence and community acceptance rather than on the considerations of factions. The study also recommended the cessation of hate speech and media incitement.
